Off-Project Facility/Borrow Pit Hazardous Materials Questionnaire Things to Consider regarding Off-Project facilities such as Borrow Pits: Borrow Pits are not typically considered part of the Federal Action and as such would NOT be assessed as part of the NEPA Environmental Document Construction Contractors are responsible for complying with all applicable local, state and federal rules and regulations" ODOT construction personnel and consultants are at risk of getting caught in the middle Environmental Programs We re from the government and we re here to help As a result of recent questions/concerns arising on several ODOT projects, Environmental Programs Division has developed a form to assist our construction partners in their selection of Off-Project locations for support activities, such as Borrow Pits

Off-Project Facility/Borrow Pit Hazardous Materials Questionnaire Things to consider regarding the Questionnaire: Modelled after ASTM E1528-14 Standard Practice for Limited Environmental Due Diligence: Transaction Screen Process The goal of conducting a transaction screen is to identify Potential Environmental Concerns that may cause the site to be contaminated Potential Environmental Concern: The possible presence of any hazardous substances or petroleum products on a property under conditions that indicate the possibility of an existing release, a past release, or a threat of a future release This practice does NOT satisfy the requirements to qualify for Landowner Liability Protection under CERCLA (would require a full ASTM E1527-13 Phase I Environmental Site Assessment usually performed when purchasing a property) ODOT s Hazardous Material Questionnaire is voluntary , but highly recommended

Oklahoma Department of Mines (ODM) Borrow Pit Determination ODM s general process for highway borrow pits: ODOT notifies ODM of Notice to Proceed/Work Order ODM contacts identified Construction Contractor, provides Borrow Pit Determination form to be completed by Construction Contractor and returned to ODM ODM performs a field investigation to confirm the project/pit qualifies for the government funded highway construction exemption from ODM permitting ODM has indicated they are modifying their form to also screen the proposed borrow pits for past/present coal mining activity, which may complicate the approval process

Oklahoma Department of Mines (ODM) Borrow Pit Determination Things to consider regarding ODM s Borrow Pit Process: Does not require ODOT action at the Field Division level (process is between ODM and contractor) Is not associated with ODOT s Hazardous Materials Questionnaire (two separate processes)
