Abuse and neglect What do you know?
Did you know? More than 90% of people with developmental disabilities will experience sexual abuse at some point in their lives 49% will experience 10 or more abusive incidents Only 3% of sexual abuse cases involving people with disabilities will ever be reported The Perpetrators are often not strangers, but rather caregivers or someone else who is close to the person Statistics from the Residential Director Core Training on Recognizing, Reporting and Preventing abuse and neglect Illinois department of Human Services
Group activity Break up into the following groups: Why are People with DD more at risk for Abuse and Neglect? What characteristics would you expect to see in an abuser? What are some ways you could recognize abuse/neglect? What are some excuses that could be made for not reporting ? (Good and Bad) Ideas to keep the people you support safe from abuse/neglect.
Why Are people with DD more at risk? Many caregivers, frequent turn over of staff, staff who are covering Taught to be compliant Isolation Lack of knowledge and education NO privacy Limited communication skills Often not believed or viewed as credible
Characteristics of an Abuser Having been a victim Abusing drugs/alcohol Being overly jealous Recurring mental health problems Limited social support system Displaying an attitude of indifference and non-caring for victim Controlling Difficulty Controlling Impulses Behaves immaturely
Recognizing Abuse and neglect Clients unsupervised Staff not assisting client to use adaptive equipment Using unauthorized restraints Poor hygiene/dirty Odors on person or in their environment Using improper lifting or transferring techniques In adequate medical care Not enough food in the home Untreated injuries or medical conditions Unexplained bruising or injuries
Common excusing for not reporting Too Much Paperwork Too Disruptive to the Routine of the Home or Program My Co-Workers will be Angry with me Bad things happen when you report
Ideas for keeping people you support safe Support clients in enjoyable self-esteem boosting activities Careful screening before employment Unannounced visitors Teach client rights,. Communication skills, self-advocacy, sex education, etc. to the clients Take your time, don t rush or take short cuts Teach people to say no and a good staff person will respect your no if no health and safety issue is involved Community participation, outside friends, relationships, etc.
What is Physical abuse? A person purposefully beating, striking, wounding or injuring a person; Mistreating or maltreating a person in a brutal or inhumane manner; Providing an individual with more physical assistance than needed to complete necessary skills; Using an unauthorized physical restraint not approved in a behavior support plan or BIS policy.
What is Neglect? Failure to provide reasonable and necessary services Presents imminent danger Substantial probability that death or serious physical injury Failure to provide adequate supervision resulting in a client being injured
What is Verbal/Psychological Abuse? Threats of physical violence to another person, directly to the person or about the person or in the presence of another person Calling a person names Using derogatory statements
What is Sexual Abuse? Any touching, directly or through clothing, of an individual by another individual for sexual purpose or in a sexual manner.
Sexual Abuse Includes but is not limited to: Kissing Touching of the genitals, buttocks or breasts Causing a person to touch another person for sexual purposes; Promoting or observing for sexual purpose any sexual activity or performance involving other individuals including any play, motion picture, photography, dance, or other visual or written representation Failing to intervene, or attempting to stop inappropriate sexual activity, or performance between clients; Encouraging inappropriate sexual activity or performance between clients.
What Can You do? Be observant Watch for physical signs Watch for signs in the environment Is care inadequate? Watch for changes in behavior or emotional state
If a Client Reports Abuse. What should you do? Believe him/her Protect him/her Reassure him/her Report with/for him/her
Mandated Reporting State Regulations Require You to Report Abuse/Neglect Any such employee who has reasonable cause to believe that a consumer has been subjected to physical abuse, sexual abuse, misuse of funds/property, psychological/verbal abuse while under the care of a residential facility, day program, or specialized service that is licensed, certified or funded by the department (DMH) shall immediately make a verbal or written complaint.
Mandated Reporting at BIS 1. Safety is the #1 Priority 2. Immediate Verbal Report to Supervisor 3. Complete an Event Report 4. Follow your Supervisor s Instructions All BIS Employees are Mandated Reports.
Failure to Report Any person required to report or cause a report to be made to the department who fails to do so within a reasonable time after the acts of abuse or neglect is guilty of an infraction. RSMo 630.165
False Reporting Any person who knowingly files a false report of abuse or neglect is guilty of a class A misdemeanor. Any person having a prior conviction of filing false reports and who subsequently files a false report of abuse or neglect is guilty of a class D felony
Investigation Process First, you must cooperate fully with any investigation held by BIS, the Police or DMH Failure to do so will result in your termination from employment with BIS.
