  2. Kigali Amendment: Decision XXVIII/1 Big Achievement! HFCs added as controlled substances, in Annex F to the Protocol, to be phased down Long journey: First proposal tabled in 2009, 6 years of discussion, then Dubai pathway in 2015 was the start of formal negotiations Detailed presentation (Tina) and discussion Day 2

Decision related to the Amendment: Decision XXVIII/2 Solutions to challenges identified by the parties in phasing down HFCs are dealt with in Decision XXVIII/2 The issues include: Funding issues principles and guidelines HAT exemption Technology reviews Linkages with ongoing HCFC phase-out Detailed presentation (Tina) and discussion Day 2

Energy efficiency: Decision XXVIII/3 Requests TEAP to review energy efficiency opportunities in the refrigeration and air-conditioning (RAC) sectors related to a transition to climate-friendly alternatives Invites parties to provide relevant information on energy efficiency innovations in the RAC sectors by May 2017 on a voluntary basis Ozone Sec sent a communication (17 March) to parties inviting submissions (a set of questions was included to assist parties) TEAP to assess the information submitted by the parties TEAP to report to MOP29 in November

Establishment of regular consultations on safety standards: Decision XXVIII/4 Requests TEAP to establish a task force to: liaise with stds organizations to support timely revision of stds report to 39OEWG on stds issues Parties are: urged to work with industries and stds bodies to support developing, harmonizing and revising stds to facilitate adoption of environmentally friendly alternatives to HFCs and HCFCs invited to submit info on relevant domestic safety stds by Dec 2016 (Oz Sec sent reminders with a set of questions to assist parties in making the submissions) encouragedto strengthen cooperation between national and regional committees and national ozone units Requests ExCom to consider maintaining or increasing technical assistance and capacity building, to improve cooperation between national authorities dealing with MP and national and regional stds committees Parties are to consider holding regular consultations on international safety standards with Oz Sec and international stds bodies

Decision XXVIII/4: Continued Requests Ozone Secretariat to organize a workshop on safety stds relevant to the safe use of low-GWP alternatives The Secretariat has: Contacted several international stds bodies for the workshop and to discuss further cooperation Finalized the agenda for the workshop Prepared briefing notes to be posted soon Workshopon safety standards 10 July 2017, Bangkok Agenda available: http://conf.montreal-protocol.org/meeting/workshops/safety-and- standards/presession/SitePages/Home.aspx

Decisions continued: XXVIII/5 and XXVIII/6 Decision XXVIII/5 TEAP TORS for MLF replenishment 2018-2020 The Replenishment Task Force of TEAP is preparing the report to be submitted for initial discussion at OEWG39. Executive Summary to be included in the note by the Secretariat (addendum) Decision XXVIII/6 Essential use exemption for lab and analytical uses for China, 2017 65 metric tonnesof carbon tetrachloride for testing of oil, grease and total petroleum hydrocarbons in water was approved. A new nomination has been submitted by China and being evaluated by MCTOC/TEAP

Decisions continued: XXVIII/7 Decision XXVIII/7 Critical use exemptions for approved methyl bromide for 2017 and 2018: Year/Party 2018 Australia Strawberry runners 29.730 2017 Argentina Strawberry fruit 38.83, tomato 64.10 Canada Strawberry runners (Prince Edward Island) 5.261 China Ginger, open field 74.617; ginger, protected 18.36 South Africa Mills 4.1, structures 55.0 Quantity (metric tonnes) Same parties have submitted nominations for consideration and approval this year. MBTOC/TEAP are evaluating the nominations

Decisions continued: XXVIII/8 HCFC phase-out: Taking into account the need for HCFCs after the non-A5s phase them out in 2020 (including the A5 parties needs for basic domestic needs after 2020) TEAP was requested to report at OEWG39 on: sectors where essential uses for non-Article 5 parties may be needed after 1 Jan 2020, including estimated volumes the servicing requirements for RAC equipment between 2020 and 2030 for non-Article 5 parties and recent volumes of production of each HCFC to satisfy basic domestic needs and make estimates of future production and needs of Article 5 parties beyond January 2020 Parties were invited to provide relevant information to Ozone Secretariat by 15 March 2017 (Oz Sec sent reminders on 20 February and received 8 submissions so far)

Compliance Decisions XXVIII/9 XXVIII/11 Decision XXVIII/9 Data and info reported under Article 7: 195 parties reported data (169 by 30 September 2016, 119 by 30 June 2016) Two parties had not reported 2015 data = non-compliance with data reporting obligations Decision XXVIII/10 and Decision XXVIII/11 dealt with non- compliance with respect to: Non-reporting of process agent use; and non-reporting of measures to prevent diversion to unauthorised uses of stockpiled excess production of controlled substances under Decision XXII/20 Consumption of HCFCs inconsistent with plan of action

Administrative Decisions Decision XXVIII/16 - Financial reports and budgets: Approved revised budget of USD6.7million (2016) and USD5.3million (2017) Contributions to be paid by parties: USD4.2million (2016), USD5.7million (2017) and USD5.9million (2018) Noted that not all parties have paid contributions for 2016 and prior years, and fund balance is significantly depleted Decision XXVIII/17 - 29MOP: To be held in Montreal, Canada (Dates since confirmed as 20 to 24 November 2017)

Kigali Amendment to the Montreal Protocol to phase down HFCs (a) Data reporting under Article 7 and related issues Revised forms and guidelines Timing for baseline reporting for A5 parties Reporting of mixtures and blends GWP values for HCFC-123*/124* Reporting of trade with non-parties (b) Work by SAP on updating the GWP (Group I Annex A, Annex C and Annex F) (c) Process for approving destruction technologies for substances in Annex F TEAP may be requested to assess destruction technologies so that parties may approve a list of technologies that parties can use from 2019 and 2020 (d) Progress by the ExCom in relation to decision XXVIII/2 4. Replenishment of the MLF 2018 2020 including the TEAP report 5. TEAP 2017 report (volumes I and II), including issues relating to: (a) Nominations for essential-use exemptions for 2018; (b) Nominations for critical-use exemptions for 2018 and 2019; (c) The phase-out of HCFCs; (d) Organizational and other matters.
