  1. Americans with Disability Act (ADA) Nevada Department of Education ADA Compliance Tranining

  2. What is ADA? THE LAW-The Americans with Disabilities Act of 1990 (ADA) prohibits discrimination and ensures equal opportunity for persons with disabilities in employment, State and local government services, public accommodations, commercial facilities, and transportation. It also mandates the establishment of TDD/telephone relay services. The ADA was revised by the ADA Amendments Act of 2008 (P.L. 110-325), which became effective on January 1, 2009. The ADA is codified at 42 U.S.C. 12101 et seq.

  3. Why Do We Have to Comply? The U.S. Department of Education (USED) recently received a complaint about the ability of persons with a disability to view Nevada Department of Education web pages. We worked through the complaint with USED and entered into a resolution agreement.

  4. What is Accessibility? Easy to approach, reach, enter, speak with, or use That can be used, entered, reached, etc. Obtainable and attainable

  5. Creating Accessible Office Documents The ability for everyone, regardless of disability or special needs, to access, use and benefit from everything within their environment. Degree to which a product, device, service or environment is available to as many people as possible.

  6. Creating Accessible Office Documents Our ability to participate in, and belong to, the world around us. The documents we create with our computers need to be accessible to everyone, including those with disabilities

  13. Converting Docs to PDF Adobe Pro or DC are the best options for converting documents to PDF Accessible tags are kept Easier to remediate or fix

What is next All NDE websites must be compliant If not compliant, they need to be moved onto state platform or shut down You must submit a request for all new websites Regardless of platform If State platform does not meet needs, the vendor must comply and have a plan in place to audit compliance

New Website Content All new content must be compliant starting 9/1/2016 Audio and video- must be closed captioned and/or have a transcript- Do we need to rethink our audience Do all documents need to be on a public facing website or electronic (email, fax) (i.e. Do District only documents need to be on the web?)

Current Website Content Audio and video that are not closed captioned or have a transcript will be removed until solution/software is found Web pages will be rebuilt to accommodate compliance New platform down the road All existing content must be compliant by fall 2017 (Exact Date will be announced after OCR is approved)

Official Record/Courtesy Record Courtesy Copy-Content for web is considered a courtesy copy Website will only provide 2yrs of data/content to the public Website will contain a link to request prior information if more than 2 yrs is available Prior years will be deleted for legal reasons Official Record-Content owners must follow the current policy retention procedures and archive process

  18. Web Contacts Not everyone has Adobe PRO or DC to remediate and convert docs properly Web contacts must be established for each office. Must submit compliant content Need to identify who has Adobe Pro/DC in each office
