Pending Aquaculture Lease Amendment - Timeline Apr 14, 2021: Received request from Hog Island Oyster Co (HIOC) to add certain naturally-recruiting seaweed species to authorized list of culture species. Ulva Nori Apr 20, 2022: Received updated species request and DFW recommendation, posted for public review. Dulse Ogo Photos: CDFW, CA Sea Grant, Seaweeds of AK June 16, 2022 (Today): Consider approval of lease amendment (for all four leases) authorizing harvest of all macroalgal species that naturally recruit on leaseholder s aquaculture gear. Pending Aquaculture Lease Amendment - Considerations Considerations: No Change in Operations: Proposed harvest would not increase, decrease, nor change existing operations (Class 1 Categorical Exemption, CEQA). No new culture methods involved. Commercial Harvest Restrictions: If approved, macroalgae harvest from leases are not subject to harvest restrictions in Tomales Bay (Section 165, Title 14); aquaculture businesses are exempt from commercial fishing, harvesting, processing, and marketing provisions (Section 15000, FGC). Avoidance of Herring Spawn: Winter spawn of Pacific herring on macroalgae in Tomales Bay can be protected through temporal restriction on macroalgae harvest, also in alignment with Herring FMP. 3

Pending Aquaculture Lease Amendment DFW Recommendation Approve allowing harvest and sale of all naturally-recruiting edible macroalgae from aquaculture gear on state water bottom leases M-430- 10, M-430-11, M-430-12, and M-430-15 in lease amendments with the following special conditions: 1. Macroalgae harvest activities are restricted to May 1 through Oct 31. 2. Release of harvested macroalgae into state waters is prohibited. 4
