The Belgian social dialogue model Social Peace through social dialogue, facilitated by the government negotiations between social partners, (representative employers organizations and trade unions) on socio-economic issues, such as working conditions, wages, and social security. With the government as a supporter and a mediator 4

Construction sector, Chemistry, Health Care, Banking, Retail, A Joint Committee Brings together companies/organizations that perform similar activities Determines the sectoral wages and working conditions Every company or organization is assigned to a joint committee 6

Joint Committee Composition: equal number of members from representative employer organizations and employee organizations (trade unions); a chairman (President) and a vice-chairman (social mediators from the Federal Public Service); two or several secretaries (civil servants from the Federal Public Service). 7

  8. Joint Committee Tasks (Art. 38 Law December 5, 1968): Concluding collective labor agreements; Preventing or resolving social conflicts; Advising the Government, the National Labor Council, or the Central Council for Business; Performing any task entrusted to them by law. 8

JC 337 Article 2 [The Auxiliary Joint Committee for the non-profit sector is responsible for employees in general and their employers, specifically for organizations in the non-profit sector whose activities do not fall under the jurisdiction of another joint committee that is specifically competent for this purpose. Non-profit is understood to mean without the intention of making a profit .] 13

  23. CLA Year End Bonus The amount consists of 2 parts: Fixed indexed part: Workers: 435.12 EUR; Employees: 575.91 EUR; To be indexed amount (comparison October-October). Variable part: (salary of October x 12) x 2.5%. 23

  24. CLA Year End Bonus Reference period January 1 to September 30. Each effective or equivalent worked month = 1/9 of the bonus. Month : any commitment made before the sixteenth calendar day of the month. Calculation method Pro rata of the worked and equivalent performances in the calendar year. Pro rata for part-time employees. not granted if at least equivalent existing year end bonus 24

CLA Indexation CLA December 6, 2016 The planned wages as well as the actual wages paid are linked to the moving average health index . = the average value of the health indices over the last four months = Consumer Price Index excluding certain products such as alcoholic beverages, tobacco products, and motor fuels (except LPG) 26

  27. CLA Indexation Each time the moving average index figure reaches (or is reduced) to one of the pivot indices, wages increase (or decrease) by 2%. Pivotal index: a predetermined threshold Applied from the first day of the second month following the month in which the health index reaches the pivot index that justifies the adjustment.
