Eviction Protection Grant Program The Eviction Protection Grant Program (EPGP) is a competitive legal assistance grant. - The grant funds experienced legal service providers to provide no cost legal assistance to low-income tenants at risk of or subject to eviction. - Grantees also collect and submit data on services provided and associated outcomes. 2

  3. Program Goals The goal of the Eviction Protection Grant Program is to increase housing stability for low-income tenants through: - Prevention - Justice - Diversion - Relief 3

Notice of Funding Opportunity $40 million in FY 2023/2024 grant funds are now available! - PD&R is anticipating making approximately 25 awards of $500,000 to $2.5 million each - Open to current grantees and subrecipients, and new applicants - Application deadline is August 20, 2024 Please read the NOFO for definitive, detailed instructions. 4

Eligible Applicants Non-profit or governmental entities, such as: - Legal aid organizations - Bar associations - Legal clinics - Private nonprofit or state institutions of higher education - Housing counseling or other social service organizations providing legal assistance - Local, state, or tribal agencies or courts Applicant must have at least three years of experience providing legal assistance to low-income individuals. 5

  6. Eligible Activities EPGP funds eligible legal assistance activities, such as: a. Legal representation b. Limited representation and legal advice c. Legal representation and advice on fair housing and civil rights matters tied to eviction d. Assist tenants with advocating for their interests outside the courtroom to avoid eviction through alternative dispute resolution e. Post-eviction housing stability services like sealing eviction records f. Court navigation services like a help desk g. Stabilizing referrals or services like assistance applying for public benefits h. Tenant education and outreach i. Collaboration or work to advance eviction prevention and protection tools or programs 6

Eligible Beneficiaries EPGP funds may only be used for activities targeted to benefit: - tenants who are - low income and - at risk of eviction or subject to eviction EPGP Policy Guidance on determining beneficiary eligibility is available at https://www.huduser.gov/portal/eviction-protection-grant.html#resources 7

  8. How Many, How Much, How Long? Approximately 25 awards expected Award amounts: - Minimum: $500,000 - Maximum: $2.5 million Cost sharing or matching is not required EPGP has a 2-year period of performance 8

  9. Application Package Review Section IV of the NOFO to ensure your application package contains all required forms and content. In addition to required forms, be sure to include: - Project Summary (1 page) - Narrative Response to Rating Factors (no more than 25 pages) - Required Supporting Materials HUD has provided several optional templates to assist you in preparing your application package. 9

  14. Eligible Applicants FAQs Who is eligible to apply for this grant? Non-profit or governmental entities that meet the three years of experience requirement (as defined in the NOFO) are eligible to apply. Individuals, foreign entities, sole proprietorship organizations, for-profit private institutions of higher education, public housing authorities, and tribally designated housing authorities are not eligible to apply. I received FY 2021 or FY 2022 EPGP funds as a grantee or subrecipient. Can I apply? Yes, both new applicants and previous EPGP grantees or subrecipients may apply. I am facing eviction. Can I apply? No, individuals are not eligible to apply. 14

  15. Eligible Applicants FAQs continued Can a for-profit entity serve as a subrecipient or contractor under the grant? Yes. An entity that serves as a subrecipient or contractor under the grant does not need to meet the primary applicant eligibility criteria in Section III.A. of the NOFO. Therefore, a primary applicant may choose to partner with a for-profit entity as a subrecipient or contractor. 15

  16. Eligible Activities FAQs What are the eligible activities that can be funded through this grant? The activities proposed in your project plan must be eligible legal assistance activities, as defined in the NOFO. Your project must include at least one service among categories a. through e. on pages 21 22 of the NOFO. Does our city need to enact right to counsel to be eligible for this grant? No, the grant does not require right to counsel to be codified by a city or any government. Can we use this grant to fund ongoing activities, or only new activities? Legal assistance activities may be new or ongoing. 16

  17. Chances of Success/Renewal Funding Can I schedule a meeting with HUD staff to get feedback on my application? No, we are unable to hold individual meetings with applicants, as to ensure that all prospective applicants have access to the same information during the application period. However, we will respond to any questions submitted in writing. I heard about an organization that is going to apply. What are their chances of success? This is a competitive grant. Under the HUD Reform Act, we cannot disclose information about any application. Is renewal funding available through this NOFO? Non-competitive renewal funding is not available. This is a competitive grant with a 2-year period of performance. Grantees or subrecipients that received FY 2021 or 2022 EPGP funding need to reapply to this NOFO to be considered for an FY 2023 or 2024 award. 17

Technical Corrections to the NOFO Page 7, footnote 3: 3 E.g., Legal Services Corporation funds do not allow restricts some services like class action lawsuits or serving people without citizenship documentation representing non-citizens who do not meet an eligibility exception. Page 39: 2.a. Logic Model (30 points max.) A logic model is a conceptual framework that explains the links among project elements to show sound project design. Project elements should be clear, meaningful, measurable, and realistic. While there are many versions of logic models (see link to resources for creating your logic model in Section VIII.3.), you must address the following project elements: 18
