  2. What is C&DD processing? Handling construction and demolition debris (C&DD) for purposes of separating the debris into individual types of materials as a commodity for use in a beneficial manner that does not constitute disposal. Handling includes: Receipt. Storage. Movement of C&DD from vehicles or containers to a working surface.

  3. C&DD Processing Facility A site, location, tract of land, installation, or building that is used or intended to be used for the purpose of processing, transferring, or recycling C&DD that was generated off the premises of the processing facility. This does not include a facility that is 1) a licensed solid waste transfer facility; 2) a licensed solid waste landfill; 3) a licensed C&DD landfill where processing of mixed C&DD occurs wholly within the unloading zone.

  4. Additional Exclusions Any C&DD processing facility that consists solely of containers that have an aggregate volume of 50 cubic yards or less, if the C&DD is not placed on a working surface or on any equipment used to separate C&DD into individual types of materials.

The transporting of portable containers of C&DD from a location to a C&DD facility or processing facility if the C&DD remains in the containers and is not stored for more than seven days.

  6. Standalone vs. Co-Located Standalone processing facility: A processing facility that is not located wholly within the facility boundary of a licensed C&DD facility, as that boundary is identified in the effective C&DD facility license. Rules became effective April 18, 2022, for standalone C&DD processing facilities. OAC Rules 3745-400-50 to -60.

  7. Standalone vs. Co-Located Co-located processing facility A processing facility that is located wholly within the facility boundary of a licensed C&DD facility, as that boundary is identified in the effective C&DD facility license. Rules became effective July 4, 2022, for C&DD co-located processing facilities. OAC Rules 3745-400-01, -02, -07, -11, -12, -13, and -26.

  8. Permitting and Licensing Standalone processing facilities: Permit-to-install (PTI) every five years. Annual license. Co-located processing facilities: Annual license.

  9. Standalone Processing Facility PTI and License Standalone C&DD processing facilities in operation before April 18, 2022, must apply for their initial PTI and license by Oct. 18, 2022. October 18

  10. Standalone Processing Facility PTI Application Application fee of $1,000. Processing Facility Design Plan. Fire Prevention and Response Plan. Draft of the financial assurance mechanism.

  11. Permit-to-Install (PTI) Fees Application Fee: $1,000 Due at time of application submittal. Permit Issuance Fee: $2,000 Due within 30-days of PTI issuance.

  12. Standalone Processing Facility License Application Application fee of $100. Fund financial assurance. Certified operator information.

  13. Annual License Fee Application Fee: $100 Due at time of application submittal. License Issuance Fee: $650 Due within 30-days of license issuance.

  14. Co-Located Processing Facility License C&DD co-located processing facilities in operation before July 4, 2022, must apply for their initial license by Dec. 31, 2022. December 31

  15. Co-Located License Application 2023 License Addendum Application fee of $100. Certified operator information. Construction Design Plan. Financial Assurance cost estimate. Fire Prevention Plan.

  16. Annual License Fee Application Fee: $100 Due at time of application submittal. License Issuance Fee: $650 Due within 30-days of license issuance.
