OVERVIEW Succession serves a number of different functions It serves as life security 1. It may serves as tool for settlement of latent common relationship of the members in the family. 2. It maintains the stability of relationship of some particular right. 3.
STATUTORY SUCCESSION Under the new code, the priority of successors is divided into three classes of persons. Children of the deceased are the successors of first rank and will inherit the property of the deceased in property to successors of other ranks. 1. Abolishes discrimination against children born out of wedlock. Both legitimate children and illegitimate children still have the same right. The sibling of deceased will become successors, referred to as third rank successors. 2. The spouse has right to be equally inherited successor of the first and second rank. 3.
TESTAMENTARY SUCCESSION What is Testamentary Succession mean ? Inherit means when someone legally give all of their properties to their relatives, or to their next generation family. Will explanation. A will is the legal instrument that permits a person, the testator, to make decisions on how his estate will be managed and distributed after his death.
REVERSION OF SUCCESSION OF PROPERTY TO THE STATE Article 1290 of Cambodian Civil Code: If it is uncertain whether or not there are any succession, the succession property shall constitute a juridical person. The court appoint an administrator to manage the property. The administrator responsible concerning public notice. (Creditors & Successor) The state will inherit the succession property when there is no successors, after liquidation. Art. 1299: The court confer some part the succession property to a particular persons.
