  3. Background Current Protocols implement PUCT rules 25.501, 25.502 and 25.505 to post for public access various parameters regarding SCED operations. 25.501 (j) Pricing safeguards. ERCOT shall apply pricing safeguards to protect against market failure, including market power abuse, consistent with direction provided by the commission 25.504 (b) Market power abuses include predatory pricing, withholding of production, precluding entry, and collusion. 25.505 (f) (2) If there are multiple offers for the resource, ERCOT must post the specified information for each offer for the resource, including the name of the entity submitting the offer and the name of the entity controlling the resource ERCOT Reports are posted 60 days after the Operating Day From the Protocols 3.2.5 Publication of Resource and Load Information 4. ERCOT shall post on the MIS Public Area the following information for each Resource for each 15-minute Settlement Interval 60 days prior to the current Operating Day: (a) The Generation Resource name and the Generation Resource s Energy Offer Curve (prices and quantities): (i) As submitted; (ii) As submitted and extended (iii) As mitigated and extended for use in SCED,

Disclosure Report Requested In any case, the 60 day disclosure reports now posted will have to be changed to accommodate RTC At RTC TF, the ERCOT Steel Mills suggested a new 60 day report be created that: Indicates the number of times for each SCED interval, that the QSE has changed its Resource AS offer curve within the Operating Period and if applicable, its Energy Offer curve Discloses what Resources changed their AS or Energy Offers for the current SCED interval Adds transparency and thereby allows consumers to more easily validate offer changes effecting the power costs they are paying Such a report is within the intent of the PUCT and current protocol requirements ERCOT stated that the cost of the new report in minimal RTC TF voted; 3 in favor; 4 not in favor; 4 abstentions

TAC Is Requested to Approve the New Report With the changes in timing of offer submittals, major frequency deviations obvious to all Market Participants, and the posting of ERCOT real-time reserves, a tempting incentive is created to increase offers unrelated to conditions of the Resource; but only to increase market prices Selling of a bag of ice for $50 when a hurricane is forecast At a RTC TF meeting, a Market Participant indicated that they are plan to introduce Programmatic Offer Curve Updates with potentially hundreds of updates in the Operating Period Increases the potential for computer trading errors/mistakes caused by QSE systems and passed on to consumers Without the new reports, consumers would not practicably have knowledge of these types of actions due to the complexity of the proposed new RTC reports
