Background to Chinas Anti- Monopoly Law (AML) Enacted in 2007, came into effect on 1 August 2008 Covers horizontal and vertical anticompetitive agreements, abuses of dominance, anticompetitive mergers, and anticompetitive abuses of administrative power Divided enforcement structure 3 agencies Ministry of Commerce (MOFCOM) mergers National Development and Reform Commission (NDRC) price related non-merger conduct State Administration for Industry and Commerce (SAIC) non- price related non-merger conduct

  4. Linking competition law to the development agenda From the very beginning, the Chinese government has linked competition law to the broader development agenda Part of the legal system to support a market economy Coordination role to achieve development outcomes Competition law is discussed in the context of: Innovation and innovation driven development People s wellbeing and livelihood Price regulation and stabilisation

  5. Competition enforcement and sustainable development Focus on intellectual property issues Essential goods and services as priority areas Increasing use of AML to address pricing issues

  6. Conclusion Competition law and policy is part of the Chinese government s broader reform and development agenda Express link between competition policy goals and sustainable development goals which affects the competition law discourse Some competition enforcement outcomes are consistent with sustainable development objectives
