CHAPTER 2 (COUNCIL OF ARCHITECTURE) ACouncil to be known as t he Council ofAr chitecture , which shall be a body corporate, having perpetual succession a n d a common seal, with power to acquire, hold a n d dispose of property, both movable a n d immovable, a n d to contract, a n d may by t h a t n a me sue or be sued. The Head Office of the Council shall be at Delhi or at such oth er place as th e Central Government may, by notification in t h e Official Gazette, specify.

  4. THE COUNCIL SHALL CONSIST OF TH E FOLLOWING MEMBERS, NAMELY:- Five architects possessing recognized qualifications electedby the I n d i a n I n s t i t u t e ofArchitects from amo ng its me mb ers. Two persons nominatedby theAll India Council for Technical Ed u c a t i o n established by the Resolution of the Governme nt of India. Five p e r s o n s elected form a mo n g t h e ms e l ves by heads of architectural institutio ns in India imparting full-time instruction for recognized qualifications. An architect from each State nominated by the Government of t h a t state. Two persons nominated by the Institution of Engineers (India) from among its members One person nominated by the Institution of Surveyors of India from among its members

An elected P r e s i d e n t or Vice- President of the Council s h a l l hold office for a t e r m of t h r e e y e a r s or till he ceases to be a m e mber of the Council, wh ichev er isearlier. The Council s h a l l m e e t at l e a s t once in every six m o n t h s at s u c h t i m e a n d place a n d s h a l l observe s u c h r u l e s of proc edur e in regard to the transaction of business at its meetings as ma ybe prescribed by regulations. In t h e case of an e q u a l division of votes, the P r e s i d e n t , or in his absence, the Vice- President or, in t h e ab s e n ce of both, t h e m e m b e r p r e s i d i n g over the meetin g , s h a l l h a v e a n d exercise a second or casting vote.

  6. The Council shall Appoint a Registrar who shall act as its Secretary a n d who may also act, if so decided by the Council, as its treasurer. The Head Office of the Council shall be at Delhi or at such other place a s the Central Government may, by notification in th e Official Gazette, specify. Every authority in India which grants a recognized qualification shall f urnish such information as the Council may, from time to time, require a s to the courses of study an d examinations to be undergone in order to obtain such qualification, as to the ages a t which s uch courses of study and examinations are required to be undergone an d such qualification is conferred an d generally as to the requisites for obtaining such qualification.

  7. The Executive Committee shall, subject to regulations, if any, made by the Council, appoint such number of inspectors as it may deem requisite to inspect any college or institution where architectural education is given or to attend any examination held by any college or institution for the purpo se of recomme nding to the Central Government recognition of architectural qualifications granted by t h a t college or institution.

  8. The Council may prescribe the minimum s t an da rd s of architectural e ducation required for granting recognized qualifications by colleges or institutions in India. 1.The Council may by regulations prescribe s t an d ar d s of professional conduct a n d etiquette a n d a code of ethics for architects. 2.Regulations made by th e Council u nd ersub- section (1) m a y specify which violations t h e re of s h a l l c o n s t i t u t e i n f a mo u s conduct in a n y professional r e s p e c t , t h a t is to say, professional misconduct, a n d s u c h provision s h a l l h a v e effect n o t w i t h s t a n d i n g a n y t h i n g c o n t a i n e d in a n y l a w for t he time being in force.

  9. CHAPTER 3 (REGISTRATION OFARCHITECTS) 1. The Central Government shall, as soon as may be, cause to be prepare d in the man n e r hereinafter provided a register of architects for India. 2. The Council shall upon its constitution assume the duty of maintaining the r egister in accordance with the provisions of this Act. 3. The register shall include the following particulars, namely :- The full n ame with date of birth, nationality an d residential the architect. address of Qualification for registration, an d the date on which he qualification an d the authority which conferred obtained t h a t it. The date of his first admission to the register. His professional address an d such further particulars as may be prescribed by rules.

A p e r s o n s h a l l be e n t i t l e d on p a y m e n t of s u c h fees a s m a y be prescribed by r u l e s to h a v e his n a m e e n t e r e d in the register, if h e reside s or carries on the profession of architect in India an d holds a recognized qualification, or does not hold s u c h a qualification but, being a citizen of India, has been en g ag ed in practice as an architect for a period of no less t h a n five years prior to the date appointed under sub-section. 5.. T h e C e n t r a l G o v e r n me n t shall, by t h e s a m e or a notification, a p p o i n t a d a t e on or before which application for r e g i s t r a t i o n , wh i ch s h a l l be accompanied by s u c h fee as m a y be prescribed by rules, shall be made to the Registration Tribunal. l ike

  11. CHAPTER 4 (MISCELLANEOUS) If any person whose name is not for the time being entered in the register falsely represents t h a t its so entered, or uses in connection with his name or ti tle any words or letters reasonably calculated to suggest t h a t his name is so e ntered, he shall be punishable with fine which may extend to Rs.1000/- After the expiry of one year from the date appointed under section 24, no person sub-section (2) of other t h a n a registered e an d style of architect. architect, or a firm of architects shall use the titl If any person contravenes the provisions of sub- section (1), he shall be punisha ble on first conviction with fine which may five hundred rupees an d on any subsequent conviction imprisonment which may extend to six months or with finenot exceeding extend to with one thousand rupees or with both.

  12. The Central Government may, by notification in the Official Gazette, mak e rules to carry out the purposes of this Act. The Council may, with the approval of th e central Government , *[by notification in th e Official Ga zette] mak e regulations not inconsistent with the provisions of this Act, or t he rules made there un der to carry out the purposes of this Act.

  13. C.O.A , REGULATIONS,1982 In exercise of the powers conferred by sub-section (1) and sub- section (2) of section 45 of the Architects Act, 1972), the Council of Architecture, with the approval of the Central Government, hereby makes the followingregulations, Regulations are divided into 8 parts and 30 sections.As below :- PART 1 (Preliminary and Definitions) PART 2 (C.O.A.
