Debates on Judicial Style: Mechanisms for Overruling Settled Case-Law
Elements of judicial style under discussion include mechanisms for overruling or departing from settled case-law, referencing previous rulings, and constructing an overarching exclusionary abuse standard. The necessity of further clarifying case-law is highlighted in the context of rebates and other forms of conduct, as demonstrated in specific cases discussed. General statements regarding the responsibility of dominant undertakings in competition law are examined with specific references to consumer detriment or lack thereof as per established case-law.
