Short term cannot last more than a year Few rights or benefits Can only be here up to three years All agencies, only a small number in MN State Not what we re focusing on today LIMITED 1,000 MAPE EMPLOYEES (ONLY IN MN STATE) 13,000 MAPE EMPLOYEES PERMANENT / UNLIMITED 43A.08, Subd 1 (9) MAPE has won considerable rights for MN State Unclassifieds, still much more to do. Many people don t understand their rights. Customized Training Reps are a special case. Normal state employee jobs Have all the rights and benefits of the contract

The Key Differences PROBATIONARY PERIODS SENIORITY AND LAYOFFS CAREER ADVANCEMENT CUSTOMIZED TRAINING REPS BENEFITS UNION RIGHTS MAPE has negotiated protections for unclassified employees that are very similar to classified employees. Huge difference between classified and unclassified positions. Unclassified jobs have much greater risk. Nearly identical. Barriers make it harder for an unclassified employee to safely try out new opportunities. The same Fewer rights, different pay structure a very different employment situation.

  4. State Statute State Statute 43A.08, "UNCLASSIFIED SERVICE," Subdivision 1.Unclassified positions. "Unclassified positions are held by employees who are: ( ) (9) presidents, vice-presidents, deans and professionals in academic and academic support programs, the Minnesota State Colleges and Universities, but not the custodial, clerical, or maintenance employees, or any employee performing duties in connection with the business administration of these institutions; ( )"

  5. Definitions 43A.02 DEFINITIONS Subdivision 11. Class "Class" means one or more positions sufficiently similar with respect to duties and responsibilities that the same descriptive title may be used with clarity to designate each position allocated to the class and the same schedule of pay can be applied with equity to all positions in the class under the same or substantially the same employment conditions.

  6. MN State Meet & Confer Goal In 2016, MN State told MAPE s statewide Meet and Confer team it was their EXPLICIT goal to convert as many classified positions to unclassified as possible they would not change current employees, but would use vacancies to convert the positions to unclassified.

  7. Seniority MN STATE CLASSIFIED EMPLOYEES UNCLASSIFIED EMPLOYEES MOSTLY NO YES You gain seniority in your classification. Primarily used in instances of layoffs. No classification seniority. Employees do gain state seniority, which merely tracks how long you ve been a state employee in continuous service.

  8. Probationary Period MN STATE CLASSIFIED EMPLOYEES UNCLASSIFIED EMPLOYEES 12 MONTHS 6 MONTHS (CAN BE EXTENDED TO 12) Not technically called a probationary period (a pre-rights period ) but it is the same in all other respects. Just like classified employees, during these 12 months you can be let go for any reason. A six-month probation, which can be extended by the employer up to an additional six months. During those six months, you can be let go without cause.

Layoffs MN STATE CLASSIFIED EMPLOYEES UNCLASSIFIED EMPLOYEES NO GUARANTEES IF THERE IS A REDUCTION IN FORCE OR TERMINATION OF AN APPOINTMENT RIGHTS TO BUMP, TRANSFER OR BE RECALLED If you have more seniority than someone in the same class and class option, you will keep a state job in event of layoff. If you are laid off, they must recall you before filling any vacancies in classifications you ve worked in. You get the same payout of sick and vacation as a classified employee. You can ask to interview for vacant job. No rights at all once your appointment is ended you are out of the system.

Career Advancement MN STATE CLASSIFIED EMPLOYEES UNCLASSIFIED EMPLOYEES GREATER FREEDOM MOVING IS MORE RISKY If you start a new classified job, you have another six-month probation, but failing probation only returns you to your old classification. Allowed to take leaves from classified service to take unclassified jobs, again preserving your job security in a classified job. Moving to any new unclassified job requires a new 12-month pre-rights period. If you don t work out in the new job, you have no rights to return to a previous job if it has been filled by a permanent replacement, or to any job at all.

  12. Customized Training Rep MN STATE CUSTOMIZED TRAINING REPS UNCLASSIFIED EMPLOYEES No pre-rights period." Employment is always at-will. Can appeal termination to college/university president and to the System Office, but not file a grievance. Salary and bonus system based on performance and varies by individual. After pre-rights period, employees have same protections from unfair firing as classified employees. Can file grievances on termination. Salaries are part of the grid in the contract, negotiated collectively.

  13. Union Rights MN STATE UNCLASSIFIED EMPLOYEES (INCLUDING CUSTOMIZED TRAINING) CLASSIFIED EMPLOYEES Right to join a union is legally protected at all times. Right to serve as a union officer or steward is legally protected. Right to have representation in any conversation that might result in discipline. Right to have union help with performance appraisal appeals, FMLA and ADA issues, and harassment or discrimination complaints.

  14. Union Rights Cont. MN STATE UNCLASSIFIED EMPLOYEES (INCLUDING CUSTOMIZED TRAINING) CLASSIFIED EMPLOYEES Eligible to participate in Meet and Confer activities. Can represent MAPE on a MN State Committee. Employer cannot discriminate against you for union activism. Can vote on MAPE Contract and MAPE officers if a member of the union. Eligible to participate in Meet and Confer activities. Can represent MAPE on a MN State Committee. Employer cannot discriminate against you for union activism. Can vote on MAPE Contract and MAPE officers if a member of the union.
