  3. Discrimination Definition: Different treatment which makes a distinction of one person or a group of persons from others; either intentionally, by neglect, or by the actions or lack of actions based on

  4. Six Protected Bases for WIC Race, Color, National Origin, Age, Sex, Disability.

  5. Disability Discrimination Section 504 of the Rehabilitation Act of 1973, 7 CFR 15b prohibits discrimination based on disability in programs or activities receiving Federal financial assistance. Americans with Disabilities Act (ADA) of 1990, ADAAA of 2008, 28 CFR Part 35, Title II, Subtitle A prohibits discrimination on the basis of disability in all services, programs and activities provided to the public by State and local governments. Civil Rights Laws protect persons with disabilities who apply for or participate in all FNS funded programs.

Disability Discrimination New verbiage The Americans with Disabilities Act (ADA), Amendments Act of 2008 clarified the definition of disability to include functions of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulator, cardiovascular, endocrine, and reproductive functions (this is not an exhaustive list, by the way). The expansion of this definition allows Federal and State agencies to work with individuals with any disability to ensure that they have equal access to program services and benefits. New Verbiage: Functions of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, cardiovascular, endocrine, and reproductive functions. (ADA Amendments Act of 2008)

  7. Disability Discrimination Reasonable modifications must be made in policies and practices for persons with disabilities in order to access benefits. Accommodations Must be funded through State/local offices, not by applicants and participants. Require good communication between all parties involved. Provide the same level of service to applicants and participants in an alternative way.

  8. Disability Discrimination Accessibility of State and local agency websites, and online application systems to persons with visual impairments and other disabilities. Physical Program access to persons in wheelchairs and with mobility disabilities. Accessibility through Braille, large print and audio tape and other alternative formats. Effective communication through qualified sign language interpreters. Women, infants or children must be accommodated if medically or nutritionally warranted. (7 CFR 246.10(c) - Nutrition tailoring).
