  2. QUESTION: Is it illegal for noncitizens to vote in our elections?

  3. THE ANSWER: Yes. And... No.

  4. THE ILLEGAL IMMIGRATION REFORM AND IMMIGRANT RESPONSIBILITY ACT OF 1996

  5. The Illegal Immigration Reform and Immigrant Responsibility Act is a federal law that includes language stating that it is unlawful for noncitizens to vote in Federal elections. Punishment for violating the law is a fine, not more than one year in prison, or both. Note: Federal law also states that noncitizens who violate the law are inadmissible (ineligible to receive visas and ineligible to be admitted to the U.S.) and deportable. Noncitizens can potentially vote 1) if the elections being held include offices other than Federal; 2) If noncitizens are authorized to vote in the non-Federal elections by state constitution or statute, or local laws; and 3) if the elections are conducted in such a way that noncitizens are not given the opportunity to vote for one or more candidates running for Federal offices.   9. If you think that law is too loose, too vague, doesnt seem very enforceable just wait. There s more you need to know about the threat of noncitizens being able to vote in our elections. A lot more.

  10. FIRST, SOME BASIC INFORMATION ABOUT NONCITIZENS AND VOTING.

  11. All state constitutions mention U.S. citizenship in regards to who can vote in that state's elections, though most do not specify who cannot vote. As of March 2024, seven states specified that noncitizens may not vote in state and local elections: Alabama, Arizona, Colorado, Florida, Louisiana, North Dakota, and Ohio. As of March 2024, the District of Columbia and municipalities in three states allowed noncitizens to vote in local elections. The three states are California, Maryland, and Vermont. "Municipalities can expand voting rights in local elections if there are no explicit state constitutional or legislative impediments and so long as local jurisdictions have the power of home rule. - Joshua A.   13. In 2017, Douglas named 14 states where local governments could pass their own voter qualification laws because their state constitutions posed no clear obstacles to doing so.   15. In June 2022, the New York State Supreme Court for Staten Island ruled that New York City s law allowing noncitizens to vote in municipal elections was unconstitutional. In February 2024, the Appellate Division for the Second Judicial Department in New York upheld this ruling upon appeal. In July 2022, a California judge ruled that the San Francisco ordinance allowing noncitizens to vote for members of the Board of Education violated the state constitution. Source: Ballotpedia.org

  16. In 2024, voters in three states will vote on citizenship requirements: Iowa, Kentucky, and Wisconsin. In Wisconsin, the following language would be added to the state constitution: "Only a United States citizen age 18 or older who is a resident" may vote in a national, state, or local office or statewide or local ballot measure election. In Iowa, the measure would repeal and replace a part of the state constitution and would provide that only a citizen of the U.S., instead of every citizen of the U.S., can vote. This would also stop local governments from allowing noncitizens to vote. In Kentucky, the state constitution would be amended to provide that only United States citizens can vote in elections in the state, including elections for school trustees and common school district elections.   17. NO MEANINGFUL PROTECTIONS

  18. QUESTION: What safeguards exist to ensure noncitizens cannot register to vote? ANSWER: All that is required is a signature attestation that the person registering is a citizen. The US Supreme Court has deemed this sufficient. Source: Election Integrity Network, whoscounting.us

  19. 1993: The National Voter Registration Act (NVRA) requires states to accept the federal voter registration form. While the federal form contains a box to check, indicating the registrant is a U.S. citizen, there isn t any language in the NVRA that actually requires proof/documentation be provided. As a result, the US Supreme Court has ruled that states may NOT require documentary proof of citizenship in order to register to vote in a federal election if the federal form is used (and remember, states are required to accept the federal form). Although there are penalties laid out in the law for registering to vote as a noncitizen, there seems to be little, if any, enforcement. Source: Election Integrity Network, whoscounting.us

  20. The NVRA also requires state Department of Motor Vehicle (DMV) offices and social services agencies to register every person who does business with them. Many states now automatically register people to vote when they come into contact with the DMV unless they opt out of registration. The NVRA was a major infringement on state sovereignty regarding the administration of elections which was supposed to be the state s responsibility and right.   21. REAL ID requires proof of citizenship if the person is a citizen. However, lawful permanent residents, nonimmigrants, asylum seekers, and various other categories of noncitizens are also eligible for REAL IDs. Therefore, REAL IDs cannot be used to distinguish citizens from noncitizens. Remember, DMV s must offer voter registration applications to everyone who does business with them.   22. The overseas voting regulations are a mess too. The Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA): This federal statute allows people to register and vote by email without a residence in the United States, and without any ID or proof of citizenship.   23. The program was supposed to help military personnel and their families vote while deployed. However, in 2020 the UOCAVA vote was 63% civilian. Note that military dependents are considered military, not civilian. UOCAVA has become a major loophole for people who live overseas who don t have to prove their citizenship, who they are, or that they ve ever lived in the USA. They can submit a voter registration using the federal form and they re able to ask for and receive a ballot, and cast that ballot.   24. Student IDs In many states, student IDs are an accepted form of ID for voting. Note that foreign students are also issued student IDs. This creates yet another pool of potential noncitizen voters. Source: Election Integrity Network, whoscounting.us

  25. The left continues to attack the integrity of our elections, using policies that practically invite noncitizen registration and voting. Two more examples are - same day registration (almost half the states allow same day registration), and automatic registration of every person on any government list. The radical, far-left Michigan Sec. of State went so far as to automatically register everyone who is released from prison. Is citizenship being checked prior to being added to the rolls in Michigan?   26. Additionally, left-wing groups persistently and aggressively fight every effort to safeguard our elections. They exploit every vulnerability and work hard to stretch those vulnerabilities as far as they can. One example of this exploitation is Executive Order 14019.

  27. EXECUTIVE ORDER 14019

  28. On March 7, 2021, President Biden issued Executive Order 14019, directing all federal agencies to develop a voter registration and voter education plan, using federal personnel, federal tax dollars and other federal agency resources for these political campaign activities. In plain English, this means that every federal agency, and those offices present in every state, are required to provideregistration information toeveryone who comes into contact with that office/agency.   30. What protections exist to stop noncitizens from registering to vote when they come into contact with DHS or other federal agencies? What documentation of citizenship is required?   31. Furthermore, there are left-wing groups involved in these efforts to use federal agencies to register anyone and everyone.   32. Now, think about the border invasion that has occurred over the last 4 years. Are there enough safeguards in place to stop even just a fraction of noncitizens (whether legally or illegally here) from registering to vote and casting a vote?

  35. 1. Congress must amend the NVRA and UOCAVA to require documentary proof of citizenship to register to vote in a federal election, and the overseas voters should also be required to show documentary proof of citizenship to vote (a copy of a US passport). The NVRA should be amended to require the following disclosure be made to every person before being registered to vote: Registration is for us citizens only, and if you are not a citizen of the united states, you cannot register to vote. Registering to vote if you are not a citizen is a federal crime and subjects you to deportation. Even noncitizens who don t speak English know the word deportation.   37. 3. The provision in the federal criminal code prohibiting non-citizen registration and voting should be strengthened to make it possible to prosecute offenders. 4. A new provision should be added to the federal criminal code to criminalize the registration of noncitizens by a person who can reasonably infer that the person being registered is not a US citizen. Any state or locality that allows noncitizens to vote in a state or local election should lose all federal funding for elections and should be required to maintain two separate voter registration databases, ensuring that only US citizens are allowed to vote in any federal election.   40. 1. If an identification or permit to drive is issued to noncitizens, ensure that it is clearly discernible as a noncitizen permit or identification ONLY. Do not give driver s licenses to noncitizens who are here illegally. Remember, noncitizens are not always illegally here. Some are legally in the USA, but they are still not allowed to vote. 2. State election officials must create a process in cooperation with the DMV and social services agencies to ensure that noncitizen registrations are not included in the registrations forwarded from DMV and social services agencies to the state election offices.   43. 1. Ask local and state election officials what safeguards exist to ensure that noncitizens are not registered and are not voting in your city or county, and insist on safeguards to protect voting in your state and your local jurisdiction. 2. Find out which advocacy groups are registering people to vote and what steps they are taking to ensure they are not registering noncitizens to vote.   44. 3. Contact your representative and both of your senators and tell them to support the Safeguarding American Voter Eligibility Act (SAVE Act). It was introduced by Congressman Chip Roy and is supported by Speaker Johnson and President Trump. The SAVE Act simply says, if you are going to use the federal form to register voters (which every state is required to do), then the person registering to vote must provide documentary proof of U.S. citizenship. This bill would also plug the overseas loophole discussed earlier.

  45. 4. Spread the word about the SAVE Act and get others to express their support for it to Congress as well. This includes writing letters to the editor and calling into talk radio shows. 5. Get local and state government bodies to express support via resolutions encouraging the state s congressional delegation to vote for the SAVE Act. Speak at local meetings about the issue. 6. Hold sign waving rallies at busy intersections with signs expressing the idea that only citizens should be registering to vote and casting votes.

  47. OTHER INFORMATION

  48. Public Interest Legal Foundation regularly documents instances of foreign nationals successfully registering to vote in the USA, and has been documenting this for the last ten years. The Biden administration is handing out Social Security Numbers to illegal immigrants as quickly as possible. 8+ million illegal immigrants have disappeared into the country and nobody knows where they are. ALL states need to be concerned about this issue. Left-wing nonprofits are placing illegal immigrants all over the country and registering them to vote.

  49. The American people are with us! In January of this year, Tea Party Patriots Action commissioned John McLaughlin s company to conduct an election integrity poll. The results showed that 87% of Americans agree that proof of U.S. citizenship should be required to register to vote in American elections, and that 86% agree that only United States citizens should be allowed to vote in elections in America.   50. MOST IMPORTANTLY! Don t give up hope! If we don t fight, there is a 0% chance that any changes will be made. However, if we fight, we have a chance to make some changes and we need every change we can get! Furthermore, the American people are with us! In a recent poll fielded by Tea Party Patriots Action, 87% polled agreed that proof of citizenship should be required to register to vote, and 86% agreed that only U.S. citizens should vote in our elections.
