ETHICAL CONDUCT AND GAMBLING
Head Coach Responsibility Bylaw 11.1.1.1 An institution s head coach is presumed to be responsible for the actions of all assistant coaches and administrators who report, directly or indirectly, to the head coach. A head coach shall promote an atmosphere of compliance within his or her program and shall monitor the activities of all assistant coaches and administrators involved with the program who report, directly or indirectly, to the head coach.
Ethical Conduct & Gambling Expectation to act with honesty and sportsmanship at all times. Responsibility to report any NCAA violations. Academic Integrity coaches are not permitted to reach out directly to admissions counselors, professors, deans, etc. All those conversations need to be filtered through our athletic academic advising staff and compliance.
Ethical Conduct & Gambling Gambling Don t Bet on It! Definition: putting forth something of value for the opportunity to win something of value. Cannot gamble on any sport that the NCAA sponsors (professional or amateur). Cannot provide info to individuals involved in gambling.
Ethical Conduct & Gambling The NCAA updated its guidelines for wagering-related violations effective May 2, 2023: Student-athletes who engage in activities to influence the outcomes of their own games or knowingly provide information to individuals involved in sports betting activities will potentially face permanent loss of collegiate eligibility in all sports. This would also apply to student-athletes who wager on their own games or on other sports at their own schools.
Ethical Conduct & Gambling If a student-athlete wagers on their own sport at another school = 50% of one season. For all other wagering-related violations (e.g., wagering on professional sports): $200 or less: sports wagering rules and prevention education. $201-$500: loss of 10% of a season of eligibility, plus rules and prevention education. $501-$800: loss of 20% of a season of eligibility, plus rules and prevention education. Greater than $800: loss of 30% of a season of eligibility, plus rules and prevention education.
NAME, IMAGE AND LIKENESS
Name, Image and Likeness Where are we now: Currently, 32 states have their own NIL laws. The NCAA has not updated its interim NIL policy since June 30, 2021. Multiple federal bills have been proposed by senators, but none have been officially voted on. NCAA Guidance: As members of a voluntary association, institutions are expected to comply with NCAA rules (regardless of state law).
NIL - Institutional Involvement Permissible: Provide information to SAs about opportunities that institution has become aware of (transmit information without further involvement). *Connect* Provide SA contact information and other directory information to NIL entity (e.g., Collectives and others seeking to engage SAs). Introduce SA to representatives of NIL entity.
NIL - Institutional Involvement Impermissible: Athletics department staff member representing enrolled SAs for NIL deals, including securing and negotiating deals on behalf of the SA. NIL compensation may not be contingent upon enrollment at a particular school.
Colorado Senate Bill 23-293 An institution may identify, create, solicit, facilitate, and otherwise enable opportunities for a student-athlete to earn compensation for the use of the student athlete's name, image, or likeness so long as the institution first acquires the consent of the student athlete. An institution that solicits such an opportunity for a student-athlete must inform the student athlete of the solicitation within 72 hours after the solicitation. A charitable organization that is not an institution may compensate a student athlete for the use of the student athlete's name, image, or likeness.
Colorado Senate Bill 23-293 Please Note: State law supersedes NCAA rules pertaining to NIL. Creating NIL deals for student-athletes will conflict with the NCAA policy. Our current stance is to adhere to the NCAA policy. Our NIL Working Group is closely monitoring the NCAA landscape.
Name, Image and Likeness The Division I Council is currently developing proposals for NIL protections: 1. Develop a registration process for NIL service providers and NIL entities. 2. Create a standardized contract or contract terms that would include certain required information. 3. Establish disclosure requirements for student- athletes and/or NIL entities Planning to release proposals by October 2023.
MULTI-YEAR ATHLETIC SCHOLARSHIP PROTECTIONS
Multi-Year Athletic Scholarship Protections There will be a meeting on September 19th with Head Coaches from equivalencies sports to discuss these changes. We will have an updated NLI/Athletic Grant Workflow on ARMS by October 8thto prepare for the initial NIL date (November 8th).
Multi-Year Athletic Scholarship Protections The legislation only applies to new awards of athletically related aid by which aid is provided during the 2024-25 academic year and thereafter.
Multi-Year Athletic Scholarship Protections Will require all institutions to provide: Multi-year athletic scholarships. Institutions may not reduce the athletic scholarship for a given year after the scholarship is written unless the student-athlete triggers one of the permissible reasons to cancel a student-athlete s scholarship. Institutions may not cancel an athletic scholarship for athletic reasons.
Multi-Year Athletic Scholarship Protections An institution may cancel a student-athlete s athletic aid agreement before a student-athlete graduates or exhausts their eligibility if he/she: Is rendered ineligible for intercollegiate competition; Fraudulently misrepresents any information on an application, letter of intent or financial aid agreement; Engages in serious misconduct warranting substantial disciplinary penalty, as determined by the institution's regular student disciplinary authority; Voluntarily (on the recipient's own initiative) withdraws from a sport at any time for personal reasons;
Multi-Year Athletic Scholarship Protections Violates a non-athletically related condition outlined in the financial aid agreement or violates a documented institutional rule or policy (e.g., academics policies, athletics department or team rules or policies); or Provides written notification of transfer to enter the transfer portal. Please Note: These examples are not permissible reasons to cancel an incoming four-year undergraduate transfer athletic grant.
Personnel Staff designation form for all staff members associated with sport specific duties. Effective July 1, 2023, the NCAA removed the Volunteer Coach designation. Specific designation forms for: Student Assistant Coach Mangers Outside consultants are not permitted to provide tactical skill instruction or they become countable.
Recruiting Refresher Please refer to the NCAA Recruiting Guide for a refresher on applicable recruiting rules (telephone calls, e-mails, contacts, evaluations, etc.). Will send out the NCAA Recruiting Guide following the meeting. NCAA.org Division I Recruiting Division I and II Recruiting Calendars
Recruiting Documentation Contacts, Evaluations, and Telephone calls must be documented in ARMS. Will receive an email at the end of each month from ARMS to confirm recruitment activities. Official and Unofficial Visit Forms are submitted through ARMS Including requests for complimentary admissions
Official Visits Submit visit requests via ARMS at least 48 hours prior to start of visit. Prospects must be approved for recruitment through admissions workflow first. Boosters cannot have contact with a prospect unless it is on-campus.
Official Visits - Housing DU is allowing athletic prospects to stay in a student-athlete s room overnight for their campus visit. Please send the Compliance Office the dorm, room number, and which student- athlete the prospect will be staying with. Send request(s) 10 days in advance.
Unofficial Visits Cannot cover any expenses for PSA (including parking and meals). A proposal for the deregulation of unofficial visit meals was tabled. Off campus contact can happen within a 1-mile radius of campus.
Campus Visits - Complimentary Admissions HS/Club/2-year coaches: a max of 2 tickets can be provided for the coach and a guest. The guest cannot be a prospect. Unofficial visits: max of 3 tickets (prospect and 2 guests) Official visits: max of 4 tickets (prospect, 3 guests) Cannot provide complimentary admissions to prospect to away games or post season competition (including conference championships) Please submit all complimentary ticket requests through ARMS no less than 24 hours in advance.
TRANSFERS - TRANSFER PORTAL
Transfers Individuals enrolled at an NCAA Division I and II institutions MUST be on the NCAA transfer portal prior to initiating contact. Division III and NAIA will still need permission to contact. The NCAA is monitoring tampering from coaches, but have not publically penalized a coach yet.
Transfer Portal All undergraduate SA s are afforded the use of the one-time transfer exception which allows them to transfer once during your collegiate career and be eligible to compete immediately if the following conditions are met: They transferred while academically eligible; They have not previously transferred from a 4-year university; No tampering occurred; and Written notification of intent to transfer was provided to the institution within the following transfer windows (following slide).
Transfer Portal Fall Sports: 45 Days (beginning the day following championship selection) 15 days (May 1 to May 15) Winter Sports: 60 days (beginning the day following championship selection) Spring Sports: 45 days (beginning the day following championship selection). 15 days (Dec 1 to Dec 15) for potential midyear transfers.
Transfer Portal The following student-athletes are exempt from the transfer portal windows: Nonscholarship/nonrecruited exception. Have been officially withdrawn from most recent four-year institution for one academic year. Never triggered the enrolled student-athlete definition. Postgraduate transfer Non-Division I four-year students who transfer into Division I.
Transfer Portal Student-athletes will receive an extra 30- day period to enter the Transfer Portal if there is a head coaching change or if their athletic aid is canceled.
CAMPS/CLINICS & LOCAL SPORTS CLUBS
Local Sports Club (sports other than basketball) Coach can be engaged with the club in any capacity (coach, administrator, trainer, etc.) All PSAs participating must reside within 50 miles of DU campus. Neither DU Athletics nor a booster can sponsor a local sports club that includes PSAs. Coaches cannot be involved with teams that include current student-athletes. Local Sports Club Form must be approved in advance of beginning work with the club.
Camps & Clinics Any camp or clinic that involves prospective student-athletes 9thgrade for all sports except basketball and volleyball 7thgrade for basketball and volleyball Must include specialized instruction (cannot just be competitions) Open to any and all entrants limited only by number, age, grade level and/or gender.
Camps & Clinics Cannot occur during a dead period Must receive approval of all camp marketing materials before advertising. Must advertise at least 14 days prior to first day of camp Must receive approval to work outside camps. Noninstitutional camps must meet all NCAA camp legislation for coaches to be able to work camp.
Admissions Admissions Workflow Request must be submitted for recruits prior to offering official visit, NLI, financial aid agreement, etc. International requests must also include the International Supplement Form and transcripts in both native and English languages. All communication with Admissions must go through the Compliance Staff. DO NOT call Admissions directly regarding recruits!
Test Standards for International Students Standards that must be met to be admitted for undergrads with a native language other than English: Minimum acceptable TOEFL = 80, with no less than 18 on any individual sub- score, OR Minimum Acceptable Duolingo = 115 No subscores below 105 for Literacy, Comprehension, and Conversation or below 95 for Production
Eligibility Season of Competition How is a season of competition triggered? Any competition, regardless of time (one minute of one game counts). Exceptions: Volleyball and Soccer: Spring Season Lacrosse: Fall Season Preseason exhibitions/practice scrimmages (only those that are legislated by NCAA rules) Alumni game or fundraising activity if the event is exempted from the max number of contests for the season. When in doubt check with the Compliance Office!
Eligibility Five-year Rule: Five years to complete four seasons of competition. DU philosophy is to graduate our student-athletes in four years. COVID-19 waivers have provided all 2020 spring, 2020 fall, and 2021 winter sport student-athletes with an additional year of eligibility. Merit aid or need based aid awarded by DU exhausts after 4 years.
Continuing Eligibility Standards General Requirements: Must be enrolled in 12 or more credits at all times (full-time) and 8 or more credits for graduate school. Must pass at least 6 degree applicable credits per quarter. Must maintain a 2.0 cumulative GPA (3.0 for graduate students). Good academic standing according to DU. Freshmen: Must earn 36 credits by following Fall. Continuing SAs: Must earn 27 credits in Fall/Winter/Spring (can t count summer).
Continuing Eligibility Standards Percentage Toward Degree 40% of degree by Junior year 60% of degree by Senior year 80% of degree by 5thyear
Initial Eligibility - Qualifier Eligible for athletic aid, practice and competition during first year of residence if: 1. Meet the 16 core course distribution; 2. Meet the 10/7 requirement; and 3. 2.300 core course GPA SAT/ACT is no longer required
