  1. EMERY SCHOOL DISTRICT CODE OF CONDUCT AND APPROPRIATE BEHAVIOR POLICY

  2. HB 391 S2 (2019 UTAH STATE LEGISLATURE) WAIVES GOVERNMENTAL IMMUNITY FOR AN INJURY CLAIM RESULTING FROM A SEXUAL BATTERY OR SEXUAL ABUSE OF A CHILD BY A SCHOOL EMPLOYEE UNLESS:

  3. HB 391 S2 (2019 UTAH STATE LEGISLATURE) THE LEA ESTABLISHES AN APPROPRIATE BEHAVIOR POLICY AND HAS TAKEN REASONABLE STEPS TO IMPLEMENT AND ENFORCE THE POLICY

  4. DEFINITIONS: Staff Member: an employee, contractor, or volunteer with unsupervised access to students. Student: A child under the age of 18 or over the age of 18 if still enrolled in a public secondary school.

  5. PROFESSIONAL BOUNDARIES Boundary Violation: crossing verbal, physical, emotional, or social lines that staff must maintain in order to ensure structure, security, and predictability in an educational environment.

  6. PROFESSIONAL BOUNDARIES Boundary violations may include: Isolated interactions with students Meeting in enclosed areas Risqu jokes in the presence of students Favoritism Giving gifts to students Isolated frontal hugging/uninvited touching

  7. PROFESSIONAL BOUNDARIES Photographing an individual student Inappropriate/unprofessional contact outside educational program activities Exchanging personal email or phone numbers for non-educational purposes or use Interacting privately with a student through social media, computer, or handheld devices Discussions of personal life with students

  8. PROFESSIONAL BOUNDARIES Within boundaries include: Offering praise, encouragement, etc. Rewards available to all who achieve Asking permission to touch for necessary purposes Giving a pat on the back or shoulder Giving a side hug

  9. PROFESSIONAL BOUNDARIES Within boundaries include: Giving a handshake or high five Offering warmth and kindness Utilizing public social media alerts to groups of students or parents Contact permitted by an IEP or 504 Plan

  10. GROOMING Befriending and establishing an emotional connection with a child or a child s family to lower the child s inhibitions for emotional, physical, or sexual abuse.

  11. SEXUAL CONDUCT Includes any sexual contact or communication between a staff member and a student including, but not limited to: Sexual Abuse Sexual Battery Sharing sexually explicit or lewd communication, images, or photographs.

  12. EMERY SCHOOL DISTRICT POLICY Staff members shall act in a way that acknowledges and reflects their inherent positions of authority and influence over students.

  13. EMERY SCHOOL DISTRICT POLICY Staff members shall: Recognize and maintain appropriate personal boundaries with students Never subject a student to any form of abuse, including physical, verbal, sexual, or mental. Never make students feel uncomfortable by inappropriate touching

  14. EMERY SCHOOL DISTRICT POLICY Staff members shall: Never engage in any sexual conduct or sexual relations with a student Communicate with students only on a professional level and within acceptable boundaries Never provide gifts, favors, or preferential treatment to a student or group of students

  15. EMERY SCHOOL DISTRICT POLICY Staff members shall: Not discriminate against a student on the basis of sex, religion, national origin, gender identify, sexual orientation, or any other prohibited class. Comply with district policies when communicating with students electronically

  16. EMERY SCHOOL DISTRICT POLICY Staff members shall: Not be under the influence of alcohol or illegal substances, or use tobacco or e-cigarettes during work hours on school property or at school-sponsored events while acting as a staff member.

  17. EMERY SCHOOL DISTRICT POLICY Staff members shall: Cooperate in any investigation concerning allegations of actions, conduct, or communications that if proven, would violate this policy.

  18. EMERY SCHOOL DISTRICT POLICY The Emery Board recognizes that familial relationships between a staff member and a student may provide for exceptions to certain provisions of this policy. Conduct prohibited by this policy is considered a violation of this policy regardless of student consent.

  19. EMERY SCHOOL DISTRICT POLICY Reporting violations of this policy: Immediately report to supervisor or school administrator Law Enforcement or DCFS Utah Professional Practices Advisory Commission (UPPAC)

  20. EMERY SCHOOL DISTRICT POLICY Requires new employees to be trained within 10 days of beginning employment Requires acknowledgement of training in writing All other staff are to receive training prior to the first day of the 2022-23 school year and shall acknowledge in writing receiving such training.

  21. NOTE: A STAFF MEMBER FOUND TO BE IN VIOLATION OF THIS POLICY WILL BE SUBJECT TO DISCIPLINARY ACTION.
