Request for Compliance Date Extension to August 1, 2027 The Impact of Requested Exemption Climate Impact of HFC Use in Laboratory Shaker Business Laboratory use makes up less than 1% of total HFC use in the United States. HFCs used in laboratory shakers represent only a small share of this 1%. HFC 134a used by Eppendorf annually: 392kg (avg) o 0.0275% Annual Consumption Allowance Laboratory shakers rarely leak because they are hermetically sealed and maintained in laboratory conditions. Eppendorf provides warranty repair service for its customers. Shakers that undergo warranty repairs for refrigeration issues (< 1%) are not vented, as refrigerants are recovered in the repair process. Request for Compliance Date Extension to August 1, 2027 Next Steps: What are the options? What is needed from Eppendorf to further the case for short term exemption through Q2 2027? What is the timeline are we looking at for a decision? Eppendorf SE | AIM Act Technology Transitions Rule | Laboratory Shakers | April 8, 2025 7
Potential Approaches to an Extension Discussion of Potential Approaches We believe an extension of the compliance date for refrigerated laboratory equipment to January 2028 (Amended post meeting to read Aug 1, 2027)may require rulemaking, with three potential variants: Notice-and-comment rulemaking with a proposed rule, comment period, and final rule Petition for reconsideration elaborating the basis for new rulemaking submitted by Eppendorf Interim direct final rule We welcome any additional thoughts on a path for an extension Eppendorf SE | AIM Act Technology Transitions Rule | Laboratory Shakers | April 8, 2025 8
Potential Approaches to an Extension Proposed Extension: Precedent Relevant precedent exists for providing an extended compliance deadline for certain equipment. The Proposed Rule included appliances used to cool data centers and data servers in the IPR subsector. 87 Fed. Reg. at 76774. EPA undertook a more significant re-categorization of an entire subsector in the Final Rule when it moved data center, ITEF, and computer room cooling equipment into a new subsector subject to a higher GWP limit of 700 and a later compliance deadline of January 2027. 88 Fed. Reg. at 73147. Eppendorf SE | AIM Act Technology Transitions Rule | Laboratory Shakers | April 8, 2025 9
