Full-time noncredit faculty are not included. The noncredit portion of the load of full-time faculty who teach other credit classes is not included. Non-instructional activities of counselors, librarians, and other faculty are included. Release/reassigned time is included. Overload is excluded. Any workload attributed to replacing full-time faculty for sabbatical, released/reassigned time, paid medical leave, unpaid leave, and for late retirements is excluded. The District has consistently exceeded the State Required FON. The 2021-22 State budget provided funding to hire 30 full-time faculty in 2022-23. Thus, the FTEF increased in Fall 2022. In Fall 2024, the State applied a 8.74% revenue deficit factor based on the 2023-24 apportionment calculation in April 2024. This reduced the District s required FON by 24 from 373.9 to 349.9. The FON calculation will be updated and revised at the 2023-24 recalculation apportionment cycle in February 2025 reflecting any deficit factor in effect at that time. In Fall 2024, the District exceeds the required FON by 65.3 FTEF (18.7%). 2

Recommended Full-time Faculty Hiring for Fall 2025 Given that the District is 65.3 (18.7%) above the State required FON, the Chancellor recommends that no full-time faculty be hired for Fall 2025 except in limited situations where hiring is necessary due to accreditation, licensing, or specific program requirements or needs. 3

  4. 50% Law: Purpose and Requirement Purpose To ensure that expenditures are dedicated to direct instruction to students. Requirement per Education Code Section 84362 there shall be expended each fiscal year for payment of salaries of classroom instructors by a community college district, 50 percent of the district s current expense of education. Salaries of classroom instructors are those whose time was devoted to the teaching of pupils in the district. Includes full-time and part-time faculty, as well as classified instructional aides whose duties include instructional tasks. Excludes categorical and grant funded expenditures. Excludes counselors, librarians, non-instructional assignments, release/reassigned time. 4

  5. C onsequences of Non-C ompliance/Waivers The amount of the deficiency in the expenditures for instruction will be expended for salaries of classroom instructor during the next fiscal year. Districts may file waivers to avoid penalty if they can demonstrate: Payment of deficiency would cause a serious financial hardship to the District. or Result in classroom instructors salaries to be in excess of salaries paid by similar districts. 5
