As of October 13, 2020 Residential Setting Validations: 271 Non-Residential Setting Validations: 27 Individual Experience Assessments: 1,421 representing 1,054 settings HCBS Updates OADS Mini DLRs (1,078): 354 Settings Findings Reports sent to providers: 215 Remediation Responses submitted: 137 MaineCareMember Benefit Policy Updates: https://www.maine.gov/dhhs/oms/providers Procedure Manual Updates

Federal HCBS Rule: Reinforces self-determination related to: What services are received Who will deliver services & support To live in their own homes To engage in community life Cover Letter Emailed with Setting Findings Report Defines standards for physical and programmatic characteristics of the setting Affirms participant rights related to: Individual choice Autonomy Privacy Interaction with the broader community Other protections Maine s decision to apply some of the HCBS standards to all provider-owned or controlled settings (residential and non- residential)

  7. Provider Self-assessment Followed by validation through: Onsite or virtual onsite visit OR Individual Experience Assessment(s) IEA interviews Desk Level Review

  8. Once you receive the setting findings report Submit plan for remediation within 30 days Setting Findings Report

  9. Maine HCBS Portal Completing Report with Remediation Steps & Target Dates

  10. State Review and Return of Approved Transition to Compliance Plan You will receive an approved Transition to Compliance Plan As proposed With changes We are finalizing processes to send TTCPs once up & running, our goal is to send approved TTCP within 30 days Once you accept, becomes the setting s final Transition to Compliance Plan Accept! Transition to Compliance Plan

Semi-annual Updates on Progress AFTER THE SETTING S APPROVED TRANSITION TO COMPLIANCE PLAN IS IN PLACE Your next steps are to begin implementing the planned remediation You will receive a reminder with instructions approximately one month before due date of progress updates All remediation steps must be completed no later than July 31, 2022 Transition to Compliance Plan

  12. SUBMITTING EVIDENCE OF COMPLETED REMEDIATION You can submit evidence of remediation at any time Upload under Provider Evidence of Remediation on the Setting s Profile Page Upload here! Transition to Compliance Plan

For Example: SUBMITTING EVIDENCE OF COMPLETED REMEDIATION Remediation in response to self-assessment question 12C, start file name with 12C If evidence of remediation is new, 12C-NEW If evidence of remediation is revised, 12C-REVISED * Then finish naming: 12C- NEW-Door Lock Photo or 12C-REVISED-Visitor Policy Please highlight revised documents Transition to Compliance Plan Be sure to remove PII!

  14. Any Questions or Concerns Shared Commitment! Please reach out to Heidi Bechard Jr. Subject Matter Expert who has completed findings report is also available for questions or technical assistance needs Transition to Compliance Plan

Final Guidance & Requests Please wait until receiving an approved Transition to Compliance Plan (TTCP) to complete remediation efforts and start uploading evidence Read Minimum Required Remediation closely and ensure what you re proposing (and taking action on) will cover all aspects of minimum requirements can also cut/paste into plan Follow detailed guidance in TTCP email (and updated findings report cover letter) that gives specific instruction on how to title, highlight and upload remediation Ensure evidence of how new policy or procedures have been put into practice and implemented Plan to share best practice examples of policies, procedures and implementation as they are submitted in future monthly provider meetings
