  1. How to Prepare a Record for the Supreme Court of Florida in Florida Bar Discipline Cases

  2. This presentation is intended for referees appointed in bar discipline proceedings to assist them in providing a record to the Supreme Court of Florida. Bar counsel will assist you with this administrative matter, as required by the rule. 2

  3. What is required? Rule 3-7.6(n)(3) provides that the referee, with the assistance of bar counsel, must: Certify that the record is complete; File the Index of the Record with the office of the Clerk of the Supreme Court of Florida via the Florida Courts E-Filing Portal; and Serve the bar and the respondent with a copy of the Certification and Index of the Record via the Florida Courts E-Filing Portal. 3

  4. What is the record? Rule 3-7.6(n)(2) provides that the record includes all items properly filed in the cause including: Pleadings; Recorded testimony, if transcribed; Exhibits in evidence; and Report of the Referee 4

  5. Filing the Record The bar and the respondent must use the Florida Courts E-Filing Portal for all documents filed with the referee. All service must be made via the Florida Courts E-Filing Portal. Each filer must add the referee as an interested party and serve the referee via the portal. The documents will be docketed by the Supreme Court of Florida Clerk s Office. 5

  6. Preparing the Index Each item is listed in a numbered list in chronological order with the date filed. 6

CERTIFICATION OF RECORD & INDEX The referee files a signed document certifying that the Index of Record is complete under Rule 3-7.6(n)(3) with the Supreme Court of Florida via the Florida Courts E-Filing Portal and serves The Florida Bar and the respondent via the Portal. A sample Certification of Record & Index is provided in the Referee Manual. 8

  10. Report of Referee The referee must affix the referee s electronic signature to the Report of Referee using the /s/ format. The referee must submit the Report of Referee in Word format to the Supreme Court of Florida by e- mail to: e-file@flcourts.org. The subject line of the e-mail must begin with the case number, followed by case style and Report of Referee. 10

  11. This concludes the preparation of the record in compliance with the Rules Regulating The Florida Bar. Your bar counsel is available to assist with this administrative matter, as required by the rule. Thank you for your assistance. 11
