  2. Independent Study: New Ed. Code in AB 130 The following Independent Study regulations in AB 130 are NEW: I.S. can be offered to students whose health would be put at risk by in- person instruction New requirements for district independent study policies New requirements for documenting and reporting participation - Live interaction and synchronous instruction requirements - Document each student s participation in live interaction and synchronous instruction for each day of I.S. - Course access provisions (A-G courses and any courses required for graduation must be offered) I.S. can be offered to students whose health would be put at risk by in-person instruction, as determined by the parent/guardian of the student - Tiered re-engagement procedures - LEA must maintain written or computer- based evidence of pupil engagement - Plan to transition students who wish to return to in-person expeditiously (no later than 5 days) Ed. Key Definitions Live interaction means interaction between the pupil and local educational agency classified or certificated staff, and may include peers, provided for the purpose of maintaining school connectedness, including, but not limited to, wellness checks, progress monitoring, provision of services, and instruction. This interaction may take place in person, or in the form of internet or telephonic communication. Synchronous instruction means classroom-style instruction or designated small group or one-on-one instruction delivered in person, or in the form of internet or telephonic communications, and involving live two-way communication between the teacher and pupil. Synchronous instruction shall be provided by the teacher of record for that pupil.

Tiered Re-Engagement Plan Must have tiered re-engagement procedures for students who are not in attendance for more than three school days or 60% of instructional days in a school week, or who are in violation of the written I.S. agreement Procedures must include: (1) Verification of current contact information for each enrolled pupil (2) Notification to parents or guardians of lack of participation within one school day of the absence or lack of participation (3) A plan for outreach from the school to determine pupil needs, including connection with health and social services as necessary (4) A clear standard for requiring a pupil-parent-educator conference to review a pupil s written agreement, and reconsider the independent study program s impact on the pupil s achievement and well-being 5

Documenting Participation Must document participation in synchronous instruction at a minimum of once a week (in whole or in part) A student who does not participate/engage must be documented as non-participatory for that school day LEAs are not required to sign and date student work products when assessing the time value of work products, as in past 6

Record Keeping Aeries for attendance and identifying synchronous instruction day Non Synchronous marked in Aeries (Q), evidence housed in Schoology Synchronous Instruction marked in Aeries (QS) with notes, evidence housed in Schoology Must maintain written or computer-based evidence of student engagement, listing all assignments, assessments, and associated grades (Schoology and/or EDGE) Student engagement log in Schoology Must maintain gradebook or lesson summary and student work sample from teacher- led synchronous lesson Work samples found in Schoology 7

AB 104 Summary Section 1 requires an LEA, upon receiving a written request from the parent of an eligible pupil to retain the pupil for the 2021-22 school year, to offer the parent a consultation with the parent, the pupil, the administrator, and a teacher. This consultation shall occur within 30 calendar days of receiving the written request for a consultation, and the LEA is required to notify the parent with the final determination of the LEA s decision within 10 calendar days of the consultation. An eligible pupil is a student in grades K through 11 who, during the 20-21 school year, received deficient grades (a D, F, No Pass, or as otherwise defined by the school agency) in at least half of their courses. Section 2 authorizes a parent or student in high school to request a grade on a transcript to be changed to Pass or No Pass Section 3 requires LEAs to exempt all juniors and seniors in 2020-21 from local HS graduation requirements if they were not on track to graduate in 4 years, and to give those students the opportunity for credit recovery or a 5thyear to complete state graduation requirements 8
