Getting Ready for Submittal Posted for 30 days Consider (and potentially incorporate) comments for 10 business days Boards/Commissions/Council optional Submit to HCD The local government of the planning agency shall make the first draft revision of a housing element available for public comment for at least 30 days and, if any comments are received, the local government shall take at least 10 business days after the 30-day public comment period to consider and incorporate public comments into the draft revision prior to submitting it to the department. For any subsequent draft revision, the local government shall post the draft revision on its internet website and shall email a link to the draft revision to all individuals and organizations that have previously requested notices relating to the local government s housing element at least seven days before submitting the draft revision to the department.
Responding to Public Comments Officially: You need to consider and incorporate public comments during the 10 business day period following the public comment period Good idea to document how you consider comments Options for documentation include: Point by point listing of each comment, and what action was taken Paragraph summary in public engagement section about types of comments received and how you incorporated them Internal memo that is available upon request A redline version of revised draft showing what changes were made to the original public draft DON T recommend including comments as a formal appendix Polite to email groups/people who responded when you send the draft to HCD
Questions Can you keep making changes during the 30 days? Yes - But keep it small Can your Commissions and Council review it during those 30 days? Up to you - Totally optional Can you post a draft with a few missing details Yes - Minor things can be left out Can you carefully consider the comments but decide not to make the requested changes? Well yeah, kind of - but remember HCD Can you get a jump start on your 90 day HCD review period by sending it in a few days early? No, never!

Exercise Rework this policy Explore opportunities for expanding homeless shelters Identify opportunities to build an additional homeless shelter in jurisdiction. Hold a stakeholder meeting with service providers to identify need. Prepare a memo for council identifying options. Hold a council hearing to discuss options. At a minimum update zoning code to allow emergency shelters in all zones.

Easy-ish Lifts Adopt incentives to create affordable ADUs by nonprofits Example (2 per property, 2 story, Allow Condo/coop-ing, Add safeguards if necessary (50 per year)) Support/fund a ADU nonprofit 99 year deed restrictions Extend density bonus to fewer than 5 units Shared housing staff Allow nonprofits to subdivide single family homes to provide duplexes, triplexes and quads (i.e. more permissive standards than SB 9) Review/update inclusionary standards
Medium-ish Lifts Programs Go all electric Allow 100% afford projects in all zones except heavy industry Extend state law protections to moderate income tenants Remove discretionary review for 100% affordable projects Policies Commit to attempt to have community engagement match the demographics of those affected. Measure your success. Ensure that housing is approved as quickly as commercial (study approval time and what can be done to quicken it) Have a policy to never upzone without considering increasing affordable housing standards
