Recent Comments Responsible Procurement of Artificial Intelligence in Government On April 29, the Coalition submitted comments in response to OMB s RFI on responsible procurement of AI in Government. Recommendations: As appropriate, the Federal government should use existing authorities and methods to purchase AI. OMB s guidance should establish that when soliciting AI solutions, agencies should prioritize the desired outcome, as opposed to the use of a specific technology. Cyber Threat and Incident Reporting and Information Sharing On May 20, the Coalition submitted comments on the Cyber Threat and Incident Reporting and Information Sharing proposed rule. Recommendations: Clarify the scope and impact of the new contract clause on incident reporting e.g., what qualifies as using or providing ICT in the performance of the contract What a potential occurrence is Conduct information exchanges between Government and Industry to better communicate on the multiple rulemakings under development Slide 4

  5. ASCEND BPA On May 30, the Coalition submitted comments on GSA s ASCEND BPA Pool 1 Solicitation. Encourages GSA to rely upon Cloud Service Providers industry standard practices and requirements to the greatest extent possible. Calls for GSA to provide flexibility to customer agencies to include non- standard and specific requirements at the task order level vs BPA level. Requests further information on: The market segment for ASCEND. How complex cloud migration and modernization efforts will be procured given the breakup of services and products into three separate pools. Slide 5

  6. Upcoming Regulatory Comments GSA PFAS (June 17) GSA published an RFI to gather information to support OMB s directive to reduce Federal procurement of products containing per- and polyfluoroalkyl substances (PFAS) while limiting unnecessary burden on industry. Coalition will submit comments by June 17. Semiconductor ANPR (Jul 2) Seeking member feedback on an Advanced Notice of Rulemaking on the prohibition of semiconductor products and services produced by certain Chinese manufacturers. Agencies prohibited from acquiring said products (or services that use covered products or services for use in a critical system . The government is requesting input on how to clarify the scope of this prohibition and what is a reasonable inquiry standard for determining whether a contractor uses or provides covered semiconductor products or services. Submit comments to Joseph Snyderwine at JSnyderwine@thecgp.org by June 17. DoD AI RFI (Jul 22) Seeking feedback on a DoD RFI on how to continue to adopt AI for defense applications. 13 questions pertaining to infrastructure/supply chain resilience, workforce, innovation, acquisition, policy, and regulatory environment. Submit comments to Joseph Snyderwine at JSnyderwine@thecgp.org by July 10. Slide 6

  7. Best Value Legislative Proposal Currently two legislative amendments relevant to best value under consideration 1. Amendment providing best value through the Multiple Award Schedule Program would amend Section 152(3)(B) of title 41, 4 United Stated Code, which covers the definition of competitive procedures from orders and contracts under those procedures result in the lowest overall cost alternative to meet the needs of the Federal Government; to contracts and order under those procedures result in the expect outcome of an acquisition that, in the Government s estimation provides the greatest overall benefit in response to the requirement to acquire products and services for the government. 2. Amendment to the FY25 NDAA that would require the OMB Director to evaluate whether the lowest price technically acceptable source selection process presents a national security risk Slide 7
