  3. Key Policy Areas in 2021 Waste Shipments EU Waste Shipment Regulation FEAD conducted a meeting with DG ENV swaste shipments team on 26 May 2021. The Commission proposed a revision of the waste shipment regulation on 17 November 2021 and has opened it for feedback. main risks: Restriction of exports. FEAD is preparing its feedback and will continue discussions with the Commission. At OECD/Basel level Recent amendments to the Basel Convention (Norwegian proposal) have been introduced with new provisions targeting waste shipments to non-OECD countries. As of its transposition into EU law (delegated act, in force as of 1 Jan 2021), the European legislator has decided for the application of the ams to intra-EU shipments. MS are currently working on non-binding guidelines giving a homogeneous interpretation (Correspondents guidelines). EC has published the non-legally binding Correspondent s guidelines on classification of plastic waste, which entered into force on 3 December 2021. The CG allow for a 6 % threshold of non-hazardous impurities/components for intra EU shipments. However, footnotes Nr. 12, 14 and 15 allow individual Member States to apply the stricter B3011 rules (i.e., 2%) also to EU3011. FEAD intensively participated in the consultations, co-signed a letter with many organisations, issued a joint statement with EuRIC and issued a letter to DG ENVI. Commission Regulation (EU) 2021/1840 amending EU rules on the export for recovery of certain waste to certain non-OECD countries entered into force on 10 November 2021. 2. ADR (transport of dangerous goods by road) September and November 2021: Meetings of the Subcommittee ADR FEAD Subcommittee ADR has compared national derogations on packaging of waste in ten countries and prepared a proposal for a common solution to discuss with the Member States, with the final objective of modifying the ADR.

Conditions: There is a waste management plan in given country Only residual waste, resulting from selective collection or sorting, is subject to energy recovery under application of the R1 Formula; The CCS/CCU feasibility is examined. 20 October 2021: Joint statement on taxonomy criteria for residual waste treatment for a successful sustainable circular economy Co-signed by CEWEP, ESWET, MWE and FEAD Underlines the need of the inclusion of waste-to-energy in the taxonomy 2nd delegated Act 25 October 2021: General secretary Valerie Plainemaison participated as a speaker on the panel discussion (ESWET event) and expressed FEAD s views on the key role of W-to-E for treating residual, non-recyclable waste.

Key Policy Areas in 2021 Waste Management and Chemicals Revision of EU legislation on hazard classification, labelling and packaging of chemicals Revision of REACH Regulation to help achieve a toxic-free environment Revising Annexes IV and V to the Regulation (EU) 2019/1021 on Persistent Organic Pollutants (POPs) regarding the waste management of certain substances listed in the Stockholm Convention on POPs; Commission Delegated Regulation amending Annex I to Regulation (EU) 2019/1021 on POPs, as regards hexachlorobenzene Simplification and digitalisation of labelling requirements Revision of Annex I and III of Basel Convention: Annex I to the Basel Convention lists the categories of wastes to be controlled under the Basel Convention, including both specific waste categories (Y1 to Y18) and wastes having specific constituents (Y19 to Y45). Annex III to the Basel Convention lists hazardous characteristics (H1 to H13). ECHA s Risk Assessment Committee (RAC) finalized a proposal indicating that lead in metallic form should be classified as very ecotoxic for the environment, no split classification between lead in its massive form and in its powder form Material/products containing more then 2.5 ppm of lead would be classified Follow up: study proposal as soon as published (before end 2021) + draft a position paper 4.

Key Policy Areas in 2021 Batteries Proposal for a Regulation ITRE (Patrizia To a S&D) adopted draft opinion on 27th September 2021 IMCO (Toine Manders - EPP) to vote on draft opinion + amendments on 9th December 2021 > 500 amendments ENVI: published its draft Report (Simona Bonafe S&D) & AM in October 2021; >1400 amendments drafting "compromise amendments expected vote 26 January 2022 FEAD prepared feedback on ENVI draft report and amendments send the feedback to MEPs FEAD continues campaigning on the Batteries regulation FEAD will prepare a position paper to mandatory recycled content as it is the main point in the proposed batteries regulation 5.

Key Policy Areas in 2021 Other Topics CO2 Study The study will show how the achievement of EU waste related targets by 2035 will result in a major contribution from the EU MS and UK towards the Paris Climate Agreement CO2 emissions reduction. Press release published on 11 November 2021 Study to be published in December 2021 The study conducted by Prognose and CE Delft, on behalf of FEAD, CEWEP, the RDF Industry Group, and DWMA. Prior to the publication of the study, an internal webinar with the will be organised for the four waste management associations. 6. JRC study: Separate collection of municipal waste: Development of a harmonised EU model The goal of this study is to develop generic technical rules and detailed measures for a potential harmonisation of municipal waste collection systems in the EU. EoW: JRC opened written stakeholder consultation and conducted a workshop as part of the study on Scoping and developing further end-of-waste (EoW) and by-product (BP) criteria . One waste stream by 2022 and 2-3 by 2024. Feedback to the Roadmap for the policy framework on biobased, biodegradable, and compostable plastics Reply to the survey on the End-of-Life Vehicles Directive revision.
