PRE-SENTENCING Pre-sentence investigations are integral to successful supervision of sex offenders Provides extensive background information that are helpful for supervision and treatment Probation also works with State s Attorney s Office regarding: Allow the defendant to complete the psychosexual evaluation prior to sentencing Addresses approved for registration Future probationer will be able to live at their current address. Evaluations can take anywhere from 3-6+ months to complete on probation Depends on the defendant s compliance, work schedule, mobility, and financials
COURT ORDERS: EXHIBIT B SEX OFFENDER UNIT Monitoring by Sex Offender Unit Requires successful completion sex offender treatment and treatment tools such as the Abel, polygraph, and plethysmograph. etc. Restricts attending certain events, participating in holidays, participating in trick or treating, dressing up as Santa or Easter Bunny, or costumes No contact with minors under the age of 17 without approved supervisor by therapist and probation or court ordered, no exceptions Approved supervisor does NOT allow overnights, no exceptions No pornography, allow inspection of cell phones, computers, and all types of computer storage, no fake addresses or renting PO Boxes Comply with sex offender registration, HIV/Blood testing, DNA registration as required by statute Defendant s are expected to inform probation of all devices capable of accessing in the internet to verify compliance
SEX OFFENDER SUPERVISION ON PROBATION Individualized approach to all probationers At times psychological evaluations can be done at no cost to the probationer by Lake County Psychological Services Ses the ARA risk assessment; however, all sex offender unit defendants are overridden from Low. Sex offender evaluations are at the cost of the defendant unless they are indigent these are completed by psychological services on a case-by-case basis These defendants are seen via Supervision Standards at least once per month. There is no low-risk reporting for this population. If a case does not have a psychosexual evaluation completed pre-sentence, these cases are for the full psychosexual evaluation and referred for a mental health evaluation to determine if there are any mental health issues, or if a sex offender evaluation is necessary New registrants notification form is completed and faxed to Illinois State Police This form contains all identifying information and starts the clock on the defendant s sex offender registration
SEX OFFENDER SUPERVISION ON PROBATION Supervision/Case Management All sex offenses/sexually related offenses are referred to the surveillance unit for field contacts Supervision standards have officers seeing clients initially 2x per month Based on compliance on probation and within treatment, a defendant may report once per month Officers communicate with local law enforcement regularly concerning all registration guidelines Verifying addresses with Offender Watch
PFSU/SURVEILLANCE Random Home visits Searches of residence for items that violate court order/treatment Manual Scans of Phones Field Search for computers Cellebrite for phones If it appears that new charges are appropriate, the State s Attorney s Office can take the lead in their cyber lab
SEX OFFENDER TREATMENT How long does it take? SO treatment can take anywhere from 18-36+ months All progress is individually based on progression through treatment phases, compliance with probation, personal growth, and clearance of polygraphs What does it look like Typical SO treatment is the group modality, upwards of 10 offenders of the same gender Containment Team Model Specialty groups for senior males, emerging adults (18- 24), lower functioning, and female defendants Team approach to supervising the defendant comprised of treatment providers, supervising PO, and surveillance PO Groups meet weekly for 90 minutes, the defendant is responsible for the cost Team communicates on a regular basis, either face to face or via phone/email, about client s progress or issues Three sex offender treatment providers in Lake County Monthly treatment staffing with each provider where each defendant is discussed
TREATMENT PROCESS Treatment Phases Extensions- Needed when a client does not complete treatment within their sentence Most programs have four phases of treatment that focus on individual sexual history, general family history, the offending cycle, victim empathy, and relapse prevention Subsidies Probation has funds to assist with treatment only for certain qualifying and indigent clients on a temporary basis Each provider has a slightly different program with the same general outline/benchmarks for completion No subsidies for polygraphs or clients in denial Polygraph Amenability to treatment All defendants take at least one maintenance polygraph and a sexual history polygraph Not every defendant is appropriate for treatment for a variety of reasons (denial, level of functioning) Goal is to not look for lies, but to verify credibility and as a measure to gain further disclosures Graduation and Aftercare Disclosures are information that the defendant may be hiding, forgotten, or didn t consider as important in regards to either the offense or their offending cycle Defendants graduate from treatment and are encouraged to complete aftercare, often complimentary
APPROVED SUPERVISORS AND SAFETY PLANS What qualifies a client for an approved supervisor? Support person meets with defendant and treatment provider to go over expectations and sign a supervisor agreement Must have passed the sexual history polygraph Defendant must not be in denial regarding any part of the instant offense Safety Plans are one-time-only agreements that allow a defendant, with a responsible support person, to be around minors Must have a solid support system either friends or family Usually these are special circumstances such as weddings, funerals, or special occasions No issues on probation or within treatment Fully invested in treatment and personal growth Treatment and probation must agree that the defendant has earned this privilege
