Legal Missouri 22 will: A Presentation by Dan Viets, J.D. Missouri NORML Coordinator
1 Legalize using, possessing, purchasing, consuming and cultivating cannabis for all Missourians over the age of 21.
2 Not impose any cap on the number of business licenses issued. DHSS, the Legislature or the Governor could order more licenses at any time.
3 Since Colorado and Washington state legalized marijuana in 2012, joined by 17 other states since then, teenage marijuana use has dropped dramatically.
4 Marijuana use by 8th graders and 10th graders has dropped by 38% according to the University of Michigan s annual survey. In Colorado, there was a 35% drop among teenagers who have used cannabis in the past month.
5 Allow every adult to grow up to 18 plants for personal use.
6 Allow dispensaries to sell seeds, seedlings and clones.
7 Will legalize giving another adult up to 3 oz.
8 Automaticallyexpunge the marijuana conviction records of hundreds of thousands of Missourians.
9 Increase state revenue and use that revenue to expunge marijuana conviction records, pay for veterans services, pay for drug addiction treatment, and help fund the Missouri Public Defender system.
10 Establish a 6% sales tax: Estimated annual revenue of at least $40 million.
11 Allow a 3% local sales tax option: Estimated annual revenue of at least $13.8 million.
12 Mandate at least 144 new marijuana small business licenses which will be awarded to people with limited capital, who reside in high-poverty communities, who are service-disabled veterans, or who have been arrested for marijuana offenses.
13 Award all new business licenses through a lottery system.
14 Establish three-year medical cards instead of one-year cards and reduce the cost per year.
15 Cut the licensing fee for medical patients to cultivate in half.
16 Provide employment discrimination protection for medical marijuana patients who use marijuana off the job.
17 Provide discrimination protection in Missouri family courts in custody and visitation disputes for adults who use marijuana responsibly.
18 Prohibit the use of No Knock and Announce search warrants in marijuana investigations.
19 Not allow the odor of marijuana aloneto be probable cause for a search.
20 Prohibit pretrial release being revoked because of legal marijuana use.
21 Prohibit probation from being revoked because of legal marijuana use.
22 Prohibit parole from being revoked because of legal marijuana use.
23 Allow anyone on probation for marijuana to petition for immediate release.
24 Allow anyone on parole for marijuana to petition for immediate release.
25 Allow many people serving prison or jail time for marijuana to petition for immediate release.
26 Require a vote of the people for a community to opt out of marijuana sales.
27 Prohibit passing a per se marijuana DWI law.
28 Double the number of patients for whom a caregiver can work.
29 Stop most of the 20,000 marijuana arrests which happen each year in Missouri.
30 Allow law enforcement to focus on violent and property crimes.
