IGA-01: Workforce Housing Priority of Governor Little Work Force Housing Fund Provides financial assistance for workforce housing development Priorities would be set by Idaho Workforce Housing Commission Growing coalition of support from across the spectrum
IGA-05 Property Tax Relief Fund Empower BOCC to levy a 1% local option tax 60% voter approval of local option sales tax to county infrastructure projects of local option sales tax to provide property tax relief
IGA-02: Regional Public Defense Authorizes counties to create regional public defense districts Establishes an annual sales tax distribution to fully fund public defense Requires property tax relief equal to the amount received in state public defense funding Repeals the county medically indigent and state CAT programs Eliminates the charity levy
Other Legislation Impacting Counties
IAC Affiliate Legislation IACRC: Extends timeline for county clerk to remit court fees to state treasurer from 5 days to 15 days. ISACC: (1) Extend timeline to report cases to county treasure from 48 hours to 72 hours. (2) Reduce timeline for cremation of abandoned decedents from 14 days to 10 days. ISA: Rule of 80 for dispatch personnel.
Property Tax Legislation H0481 - Changes market value based eligibility for circuit breaker to the greater of $300,000 or 150% of the median home value S1241 - Increases market value based eligibility for circuit breaker program from 125% of median home value to 200% of median home value S1249 - Exempts termination of RAA from 8% cap Concept: Cap local government property tax fund balances at 6 months reserves + 1 month for rainy day (7 months total). Property tax fund balances in excess of 7 months must be used for property tax relief.
Future of Online Sales Tax Distributions Recap: Online sales tax collected from a vendor with a nexus to Idaho goes through traditional sales tax distribution formula. Online sales tax collected from a vendor without a nexus to Idaho is segregated in the Tax Relief Fund. Concept: Distribute 11.5% of Tax Relief Fund to cities and counties provided 50% of distribution is dedicated to property tax relief and 50% of distribution is dedicated to general government purposes.
Property Assessments Five year moving average: Retroactive to January 1, 2022 All real property is assessed for tax purposes at the lesser of actual market value or the property s five year moving average value Dynamic property tax exemption Annual average increase in commercial property values establishes a ceiling for residential value increases Exemption is cumulative Value resets to actual market value if sold or comes under new ownership
H0474 - Limitation on County Leases Prohibits a county from entering into a lease for a county courthouse or jail without a public vote if the lease is longer than 5 years
Transportation Funding $200M ongoing funds appropriated annually from the general fund for road and bridge maintenance. 60/40 split through the highway distribution formula $80M to locals ($56M to counties and highway districts) $200M one time funds for replacement of local bridges. Funds allocated based on need through a competitive grant administered by LHTAC
