MHDOs Health Information Advisory Committee (HIAC) MHDO s Health Information Advisory Committee (HIAC) LD 541, An Act to Improve Health Care Data Analysis, now Public Law 2021, Chapter 423, created the MHDO Health Information Advisory Committee. The advisory committee is established to make recommendations to the organization regarding public reporting of health care trends developed from data reported to the organization. 2 MHDO BOARD MEETING APRIL 7,2022

  3. Membership of the advisory committee as defined Membership of the advisory committee as defined in in 8718 8718 The advisory committee consists of the following 11 members: A. The Executive Director of the organization; B. One member of the Senate, appointed by the President of the Senate; C. One member of the House of Representatives, appointed by the Speaker of the House of Representatives; D. The Commissioner or the Commissioner's designee; E. The Superintendent of Insurance or the Superintendent's designee; and F. Six members appointed by the board as follows: (1) One member representing consumers of health care; (2) One member representing providers; (3) One member representing hospitals; (4) One member representing employers; (5) One member representing carriers; and (6) One member representing the state employee health plan under Title 5, section 285. Rule Chapter 120, Rule Chapter 120, Release of Data to the Public-Major Substantive Rule December 2, 2021-MHDO Board votes to provisionally adopt the changes to Chapter 120, Release of Data to the Public, as proposed. The proposed changes to Chapter 120 became LD 1842, Resolve, Regarding Legislative Review of Portions of Chapter 120: Release of Data to the Public, a Major Substantive Rule of the Maine Health Data Organization. Legislature passes as an emergency measure; and Governor Mills signs the bill on March 16, 2022. Recommendation: Board vote in favor of final adoption of rule Chapter 120, Release of Data to the Public; and to authorize Karynlee to sign the MAPA 1 form. 6 MHDO BOARD MEETING APRIL 7, 2022

Rulemaking Requests Rulemaking Requests Chapter 570: Uniform Reporting System for Prescription Drug Price Data Sets (Major Substantive Rule) Primary Reason for Rulemaking: Incorporate the details of the three notes that address the inconsistencies in the law (PL 2021, Ch. 305) and in the rule. LD 1842, Resolve, Regarding Legislative Review of Portions of Chapter 120: Release of Data to the Public, a Major MHDO Board votes on final adoption and staff executes the implementation plan Legislative Update Legislative Update- -Second Regular Session of the 130 Second Regular Session of the 130th th Legislature Legislature Substantive Rule of the Maine Health Data Organization (passed) LD 1636, An Act To Reduce Prescription Drug Costs by Using International Pricing (TBD) MHDO Annual report to the HCIFS committee beginning January 1, 2023: Identify the 100 most costly and 100 most frequently prescribed prescription drugs in the State, the manufacturers of those drugs and the average wholesale acquisition cost for each drug for the most current 12- month period. To extent possible in collaboration with the Maine Prescription Drug Affordability Board, compare the wholesale acquisition cost to the cost in official publications of the governments of the Canadian provinces (Ontario, Quebec, British Columbia and Alberta) 11 MHDO BOARD MEETING FEBRUARY 3, 2022

LD 1867, An Act To Codify MaineCare Rate System Reform (TBD) MHDO MHDO is identified as one of the members of the MaineCare Rate Reform Advisory Panel Legislative Update Legislative Update- -Second Regular Session of the 130 Second Regular Session of the 130th th Legislature Legislature LD 1196, An Act Regarding Reporting on Spending for Behavioral Health Care Services and to Clarify Requirements for Credential by Health Insurance Carriers (TBD) MQF and MHDO Annual Report starting January 15, 2023, to the HCIFS committee and Commissioner of DHHS on behavioral health care spending in Maine using claims data from MHDO. Payers are required to provide MHDO supplemental datasets specific to: 1. Non-Claims based payments for behavioral health care services, and 2. Total payments associated with substance use disorder services that are redacted from the payor s claims data submissions to MHDO as they feel necessary under 42 CFR Part 2. 12 MHDO BOARD MEETING FEBRUARY 3, 2022

  13. Key Activities Preparing annual report on Rate of Healthcare Associated Infections in State of Maine. Developing work plan for the new reporting requirement under LD 1196, An Act Regarding Reporting on Spending for Behavioral Health Care Services and to Clarify Requirements for Credential by Health Insurance Carriers . Plan to convene a stakeholder group (late spring/early summer) to help guide the development of the annual report. Developing proposal on the feasibility of replacing the cell phone bars on CompareMaine with an alternative approach for translating the rates and/or confidence intervals for the quality measures.
