Chapter 27: Environment and Climate Change Water resources With an average discharge rate of 40 l/s/km2, volume expressed about 19.5 km3 per year, Montenegro is a part of 4% of the world's territory with the highest average runoff Bearing in mind the fact that 95.3% of waterways is formed in Montenegro, as also the source of the river basin in the territory of the state, it is reasonable to say that water is our greatest natural resource M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and Climate Change Transposition For the full transposition of the WFD into national legislation , the following is necessary to be done: Amendments to the Law on Water - 2015 The adoption of the new by - laws on the definition of the status of water 2016 Amendments to the Regulation on the classification and categorization of surface and ground waters 2016 Changes to the rules on quality and sanitary and technical requirements for the discharge of wastewater into public sewers and recipient, the method and procedure of testing the quality of discharged waters, the minimum number of tests and incorporates the established quality of wastewater - 2018 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and Climate Change Institutional framework Water management in Montenegro is regulated by the Law on Waters ("Official Gazette of Montenegro", 27/07), under which the separation of functions on the state level in this area is defined, as follows: Ministry of Agriculture and Rural Development performs administrative tasks related to development policy in water management, system solutions for the provision and use of water, water land and water sources for water supply, water protection from pollution, water and water courses, and protection from the harmful effects of water Ministry of Sustainable Development and Tourism, is responsible for integrated coastal zone management, integrated protection from pollution, waste water management, coordination of regional water supply systems M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and Climate Change Institutional framework Water Directorate, a body under the Ministry of Agriculture and Rural Development, has jurisdiction in enforcement of laws, preparing professional basis for legislation, plans and programs adopted by the Government and the Ministry in charge of water Institute of Hydrometeorology and Seismology, systematically examine the quality and quantity of water in the profiles of surface and groundwater and protected areas, establishing annual program of systematic testing of water quality Agency for Environmental Protection has the task of collecting and updating datas on the quality of all segments of the environment, including water and to report to the national and European institutions on this issue Inspection Directorate, through the inspection on water M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and Climate Change Institutional framework Water management and water land, which are of importance to the State, are in the jurisdiction of the State, while those of local interest are in the jurisdiction of the local authority The tasks performed by the public water supply company, or a company that is registered to perform these tasks (ViKs) Institute of Public Health of Montenegro performs physical-chemical analysis of water and microbiological testing of drinking water A systematic examination of the quality and quantity of surface and groundwater and protected areas is in the competence of the state authority responsible for hydro meteorological business LLD Center for Ecotoxicological Research of Montenegro is in charge for: - physical-chemical testing of drinking water, water and wastewater - examination of the radioactivity in water samples - sampling of surface water and drinking water M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment IMPLEMENTATION Agreement between the Government of Montenegro and the Republic of Croatia on mutual relations in the field of water management, prepared and signed on 4th September 2007, in Zagreb, Croatia Agreement between the Government of Montenegro and the Republic of Albania on the water issued , concluded on 31st October 2011 in Podgorica Declaration on the management of the extended Drina River Basin, 18th April 2011 Memorandum of Understanding on cross-border , expanded Drim management , between Montenegro, Greece, Albania, Macedonia and Kosovo (24th November 2011) Pursuant to the Agreement, the Commission has been established, with the aim of jointly understanding and resolving all problems related to the international river basins river basin management of M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and Climate Change IMPLEMENTATION Montenegro has recently joined the International Commission for the Protection of the Danube River (ICPDR), and the activities for the sake of including into the work of expert groups within the Comission are ongoing. The Parliament of Montenegro ratified the Convention on the Protection of the Marine Environment and the Coastal Region of the Mediterranean convention - the Barcelona and four related protocols in October 2007 Convention on the Law of non - sea routes usage of international watercourse is in the phase of proposal, and its ratification is expected to be soon Montenegro has not yet acceded to the Convention on the Protection and Use of Transboundary Watercourses and International Lakes - Water Convention, but actively participates in its activities as an observer. Chapter 27: Environment and Climate Change IMPLEMENTATION Establishing monitoring programs for water quality For the usage and protection of surface and groundwater, qualitative and quantitative parameters of water must be monitored Parameters monitored by the institution in charge for hydro meteorological business, or the Institute of Hydrometeorology and Seismology Monitoring of parameters is performed according to the annual program adopted by the Government, at the proposal of the Ministry of Agriculture and Rural Development Water monitoring program has been established and the Regulation on the classification and categorization of surface and groundwater. These acts are not in full compliance with the requirements of the Water Framework Directive Amendments to the Law on Water (2015) will bring changes to these regulations (Regulation and Program-2016-2018) and the adoption of new regulations on the definition of surface water and groundwater (2016) M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and Climate Change IMPLEMENTATION The economic price of water The establishment of the economic cost of water is foreseen by the Law on Water Management Financy, as well as by the secondary legislation arising from this Law - the Decision on the amount and method of calculating water charges and the criteria and methods of determining the level of water pollution. Adoption of the Programme of measures for each river basin district (2) is predicted for six months after the adoption of river basin management plan (Article 24 and Article paragraph.8. 32) and 2020 +6 months. Terms of reference were developed for River Basin Management plans for each catchment areas: Terms of Reference for the River Basin Management Plan in the water catchment area of the Black Sea Terms of Reference for the River Basin Management Plan in the water catchment area of the Adriatic sea M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHAMGE

Chapter 27: Environment and Climate Change IMPLEMENTATION The establishment of an efficient implementation system The Law on Water defines the penalties for non-compliance of national legislation (Articles: 164-167). Inspection supervision, within their competence, in the field of water management and water resources, is performed by the Directorate inspectors in charge for the water issues , in accordance with the Law.
