Name, Image and Likeness What is it? When can I do it? Any activity where your name, image, likeness or personal appearance is used for commercial or promotional purposes. Effective July 1, 2021, -You can be paid (i.e., cash, product or other benefit) or it can be uncompensated. -You can hire a professional services provider (e.g., agent) to represent you in Name, Image and Likeness activities. You must pay the going rate for the service. The agent must comply with the North Carolina Athlete Agent Act and any applicable federal law. -You can reference your status as a student-athlete at UMO.
Name, Image and Likeness - Examples Self-employment or business ownership sale of clothing, music, artwork, etc. Appear in TV advertisements for commercial products or services. Appear in print or social media advertisements for commercial products or services. Provide lessons, conduct camps/clinics live, in-person, or streaming online. Sell autographs on items not provided to you by UMO. Personal appearances (independent of UMO) to promote commercial products or services (e.g., appearance at a commercial establishment). Social media influencer (compensation for social media activity/posting).
Name, Image and Likeness How UMO can help UMO can help you elevate your platform and provide tools to enhance your personal brand and to be financially prudent. Build your brand and learn financial literacy skills through educational programs, Odyssey Leadership Program, and the First Year Experience class. UMO can ensure that your NIL activity is in compliance with NCAA rules. You must disclose NIL deals through completion of NIL form in advance of any activity; the form is available on umotrojans.com (student-athletes link).
Name, Image and Likeness What you can t do You can t hire an agent for future professional athletic contract negotiations. You can t be paid for work not performed, and you can t be paid more than the going rate (i.e., fair market value). You can t be paid to play at UMO. This does permit pay for play. You can t be provided compensation as a direct inducement to enroll or continue enrollment at UMO. You can t be provided compensation by UMO in exchange for the use of your name, image or likeness. You can t be paid based on a specific athletic performance or achievement (e.g., number of goals scored, what place you finish). You can t engage in NIL activities involving gambling/sports wagering, NCAA banned substances, alcohol, tobacco, or adult entertainment. You can t sell items that were provided to you by UMO (e.g., shoes, jerseys). You are still subject to NCAA extra benefit and related rules, so you can t receive an extra benefit unless you are doing something in exchange for the benefit.
Name, Image and Likeness - Logistics You must disclose all NIL agreements to Athletics at least 72 hours prior to engaging in the activity. You must disclose any agreement with an agent, advisor, marketing representative, etc. within 14 days of signing the agreement. Use of UMO marks and logos (including your uniform) must be approved in advance by Athletics. There may be an applicable fee. Use of UMO facilities must be requested and approved in advance. Facility rental fees apply. You may reach an NIL agreement with a UMO donor or sponsor. UMO may prohibit you from entering into agreements if such arrangements conflict with a contract of the institution. You may not receive compensation for NIL activity during official team activities or institution-sponsored events.
Name, Image and Likeness Other Key Considerations INTERNATIONAL STUDENT-ATHLETES: Do not enter into any NIL agreements without guidance from the Student Affairs Office. FINANCIAL AID IMPLICATIONS: Pell Grant or other need-based financial aid could be impacted based on compensation from NIL. Questions should be directed to the Financial Aid Office. WITHHOLDING, TAX and OTHER OBLIGATIONS: Responsible for all tax withholding, reporting, licenses, permissions, permits, expenses, fees, and any other obligations, liabilities or costs associated with NIL activity. PHOTOS AND VIDEOS: Photos and videos that UMO has taken or created cannot be used in NIL agreements without approval; a fee may apply. Photos and videos that are found on the internet are likely owned by someone and therefore compensation for their use may be required. TIMING: This policy applies year round.
