What is Your Role? What is Your Role? Court visitors are neutral professionals appointed by the court to evaluate the functional capacity and needs of a respondent/protected person. Your report provides significantly more information about the protected person s situation than the petition can. You provide an informed and objective view of the case, while attorneys advocate for a particular outcome. Ultimately, the judge makes the final decision.

ORS 125 ORS 125 Visitor Specific Statutes Visitor Specific Statutes 125.150 Appointment of visitors Visitor appointment is required in some cases, but permitted in others Visitors must at minimum determine/investigate the items in the statute 125.155 Visitor s report A report must at least include the items in the statute, but the SLR of your court may ask for more 125.160 Subsequent appointment of visitor The court may appoint a visitor after appointing a fiduciary 125.165 Qualifications and standards for visitors Qualifications are primarily set by the Presiding Judge of your court 125.170 Payment and reimbursement for visitor services The fee process and amount is set by the Presiding Judge for your court
UTCR UTCR Visitor Specific Rules Visitor Specific Rules 9.400 COURT VISITOR S REPORT A court visitor must file the court visitor s report in an adult guardianship in substantially the form provided at www.courts.oregon.gov/forms unless the judicial district in which the report will be filed has adopted another form by SLR or by Presiding Judge Order pursuant to ORS 125.165(1)(b) and the form adopted by that judicial district includes all of the information required.
SLR Examples SLR Examples KLAMATH SLR 9.081 UNION/WALLOWA SLR 9.145(3) [ ] The respondent or protected person may also make oral objections to the Court Visitor, who will include any objections in the Visitor Report in bold and underlined. Upon receipt of the objection, the court shall schedule a hearing and notify the appropriate parties. When objection hearings are scheduled to last two hours or longer, each party shall provide advance written notice to the Court, and a courtesy copy to the Court Visitor, if they will need the visitor for the entire proceeding. In the event the parties do not need the visitor for the entire proceeding, the court may designate a time certain for the visitor to appear no later than two (2) days before the hearing.
