PUBLIC COMMENTS Comments regarding compliance with the California Environmental Quality Act (CEQA): The Water Board should be the Lead Agency; Kern County s Programmatic EIR does not address the reuse of unblended produced wastewater for irrigation; and The Water Board should prepare a new site-specific EIR; and Not in compliance with CEQA.   18. PUBLIC COMMENTS RESPONSE: Circumstances to change the Lead Agency have not been satisfied. Kern County s Programmatic EIR covers blended and unblended produced wastewater for irrigation. Proposed Project satisfies mitigation measures identified in the Programmatic EIR. Staff finds that proposed Order complies with CEQA. Modified CEQA findings in the proposed Order.   19. PUBLIC COMMENTS Degradation of groundwater is expected to occur as a result of the proposed project. Constituents in produced wastewater are a potential concern to the environment and human health. RESPONSE: Discharger s Antidegradation Analysis complies with the State Antidegradation Policy.   20. PUBLIC COMMENTS Best practicable treatment or control (BPTC) measures are not supported by an independent analysis or consideration by the Board. BPTC measures do not consider the removal of constituents in produced wastewater. RESPONSE: BPTC is discharge specific. Proposed Order includes adequate BPTC for the proposed project.   21. PUBLIC COMMENTS Runoff to surface water or the structural failure of Sherwood s Reservoirs are not considered. Proposed WDRs need to include design and construction standards for the dams. RESPONSE: The discharge of wastes, including runoff, to surface waters is prohibited. Proposed WDRs require a construction quality assurance report prepared by a registered professional.   22. PUBLIC COMMENTS The Discharger is not required to participate in Food Safety efforts. The Food Safety Expert Panel has not prepared a report that states the use of blended produced wastewater can be extrapolated to the use of unblended produced wastewater. RESPONSE: Proposed Order was modified to require participation. Analytical results for both produced wastewater and blended produced wastewater are under review.   23. PUBLIC COMMENTS South Coast Air Quality Monitoring District study found a significant overlap of chemicals between stimulation activities and routine activities. Produced wastewater from stimulated wells and non- stimulated wells should be prohibited. RESPONSE: Detectable results for the Oil Field Chemical List are below drinking water standards. Water quality results are submitted to Food Safety Expert Panel for review. The Panel has not determined either poses a threat to crop safety or human health.
