History 1995-Florida Legislature adopted changes to existing statutes establishing a framework for coordination of planning between school boards and local governments. 1996-School Siting Ordinance was adopted by Orange County 1997-School Facilities Element was adopted as an additional element in the County s Comprehensive Plan 3

Proposed Section 38-1751(a): Scope and Application Adds provision that the ordinance shall be applicable to public schools with a permanent student capacity of 550 or more but only certain provisions, such as the height restrictions, location criteria, procedures shall be applicable to public schools with a permanent student capacity of less than 550 signage and review 6

Proposed 38-1752(a): Applicability of School Site Guidelines, Criteria and Standards Expands the current provisions exempting renovations on an existing school site to apply only to renovations that increase the permanent capacity by an amount that exceeds 15%, rather than 5%, of the highest enrollment during the 10 years prior to renovation 9

  10. Definitions of Guidelines, Criteria and Standards Guidelines are not mandatory but are considered when waivers to criteria and standards are necessary. Guidelines are set out in Section 38-1753 Criteria relate to conditions on a site or impacting a site and shall apply to school sites unless a request is made for review and approval by the BCC. Criteria are set out in Section 38-1754 Standards relate to design and layout of facilities and improvements and apply to all school sites unless the BCC approves the site with modifications. Standards are set out in Section 38-1755 The definitions will remain the same but are being added to each applicable section 10

Proposed 38-1753: School Site Guidelines Adds provision stating schools should be located where adequate public facilities and infrastructure exist or are scheduled to exist prior to opening of school and where environmental impacts are minimized Adds provision stating where practical, if there is pedestrian access from a residential neighborhood to a school site, OCPS should provide cross connectivity to promote walkable neighborhoods, but shall not be required to provide off-site improvements to enhance walkability 11

Proposed 38-1754: School Site Criteria Adds provision stating that elementary schools will be located on local streets or on collector streets situated entirely within residential neighborhoods and as close as practical to planned or existing residential neighborhoods Adds provision requiring that OCPS mitigate hazardous pedestrian conditions on a roadway immediately adjacent to the frontage of the school site Eliminates restriction to school sites being adjacent to water treatment plants, high capacity telephone or fiber optics lines Adds provision stating school sites may not be located within mile of hazardous waste facilities Adds provision restricting school sites from being adjacent to hazardous industrial uses or industrial uses that may create hazardous risks or conditions, such as chemical plants 12

Proposed 38-1755(a): School Site Standards- Acreage Requirements The acreage minimums are tied to the use of one or more of the following design techniques: Parking structures Joint use facilities Co-location of schools Off-site stormwater Multi-story schools Underground on-site exfiltration Failure to incorporate at least one of the design techniques would result in an increase in the acreage requirements by 10% 14

Proposed 38-1755(f), (h) and (l): School Site Standards- Landscaping and Buffering Codifies OCPS Design Guidelines addressing the landscaping requirements on public school sites and the implementation of the crime prevention through environmental design approach Adds provision requiring that ancillary facilities be buffered on the site to minimize adverse impacts on adjacent residential property Adds provision regulating the location and arrangement of exterior lighting 16

Proposed 38-1755(g): School Site Standards- Access Requirements Codifies statutory provisions from Section 1006.23, Florida Statutes addressing the construction of sidewalks when a hazardous walking condition affects a public elementary school Adds provision requiring OCPS submit a traffic and operational impact study and pay for any transportation improvements warranted by the study at the main entrance or exit of the school 17

Proposed 38-1755(k): School Site Standards- Runway Zones Codifies statutory provisions from Section 333.03, Florida Statutes, limiting the construction of educational facilities within 5 miles of a direct line from a publicly used airport runway but allows for request to BCC for exceptions 18

Proposed 38-1755(m) and (n): School Site Standards- Environmental Impacts Adds provision requiring OCPS participate in one or more environmental programs or initiatives to address minor environmental impacts, such as the impacts to isolated wetlands less than one-half acre Adds provision requiring OCPS to provide a tree survey of trees having a diameter at breast height of 6 or greater and to protect and preserve mature trees to the extent practicable. Exempts OCPS from tree mitigation requirements 19

Proposed 38-1755(o): School Site Standards- Signage Adds provision permitting digital signs with a maximum copy area of 32 square feet, except within 100 feet of a residential zone, the maximum copy area is limited to 19 square feet Adds restrictions for usage of digital signs, including restrictions on type of sign, required setbacks, and implementation of sleep mode 20

Proposed 38-1757: Coordination of Planning Clarifies role of OCPS and County staff in joint staff participation committees (i.e. Advance Planning, Development Review Committee) Eliminates specific reporting requirements and deadlines for such reports and instead imposes continuous communication requirements between OCPS and County staff 21

Proposed Section 38-1758: Review of Public School Sites Clarifies the statutory requests for consistency review Adds provision stating that entitlement approvals shall be deemed a consistency review and the applicable County board shall conduct a public hearing approving or denying the application within 120 days of a receipt of a sufficient application submitted to the County 22

Proposed 38-1759: Neighborhood Meeting Requirement Adds provision that the neighborhood meeting occur prior to the submission of a school site for entitlements Expanded notice provisions to add Mayor and Board of County Commissioners to list of notified parties Codifies current practice to mail notices to property owners within 1500 feet of the proposed site rather than 300 feet Eliminates requirement to advertise meeting in the newspaper and adds option for OCPS to advertise the meeting on its website 23

  24. Proposed 38-1760: Reservation of School Sites Codifies OCPS current real estate standards and requirements for clear title on all conveyances of school sites that are donated or reserved. 24
