UNIT 9: SAFETY LEGISLATING: THE FACTORIES ACT, CAP 441
A careful study of this unit will give you an understanding that an employer in addition to his common law duty to provide a safe working environment, also has a statutory duty to provide a safe and health system of work of his employees in a factory, pursuant to the provisions of the FactoriesAct,CAP 441.
A factory is defined as a place where manufacturingor processingwork isdone. The employer has a statutory duty to provide asafeandhealthsystem ofwork inafactory.
The factories Act is an addition to imposing a duty on the employer to provide a safe working environment, is also aimed at providing for the examination and inspection ofcertainplantandmachinery. It suffices from the above definition of a factory that the definition is so wide as to cover a very high percentage of workers in Zambia.
Factories must be registered with the Labour Commissionerunderpart III of theAct. Part IV of the Act provides for general health conditions in a factory. E.g. Cleanliness, overcrowding, ventilation, sanitary conveniences supervision. Lighting, medical and

Part XI of the Act provides for notification and investigation of accidents, occurrences and industrial diseases. dangerous Notice of the above, is to be given by an employer or occupier of a factory, to an inspector.
