  1. Pennsylvania Sunshine Act Amendment

  2. Senate Bill No. 554 of 2021 amends the Pennsylvania Sunshine Act, 65 Pa.C.S. 701- 716,: becomes effective on August 29, 2021; requires agencies to post the agenda of a public meeting at least 24 hours in advance of the meeting; applies to regular and special meetings i.e. - meetings during which deliberation and planned official action will take place; and does not apply to conferences, work sessions, or executive sessions.

  3. The Agenda must be posted: on the agency s website(s) including the agency s social media pages (i.e. Facebook, Twitter, etc.); at the agency s offices; and at the meeting site(s). Copies of the agenda must be available to all individuals attending the meeting.

  4. The Agenda may be changed less than 24 hours before the meeting if: the change is de minimus in nature; does not involve the expenditure of funds; and does not involve the agency entering into a contract or agreement.

  5. The Agenda may be changed during the meeting when: a member of the public brings up the matter to be added to the agenda; the matter is de minimus in nature; and the matter does not involve the expenditure of funds or entering into a contract or agreement by the agency. In such instances, the alternative is to defer the matter to a future meeting.

  6. The Agenda may also be changed during the meeting if: upon a majority vote of voting members of the board/commission; and the reason for the change is announced at the meeting prior to the vote to change the agenda. In such instances: the meeting minutes must reflect the change to the agenda; and the amended agenda must be posted no later than the first business day following the meeting.
