  2. Introduction The United Nations Convention on the Rights of Persons with Disabilities(UNCRPD) acknowledges that there is no singular definition for disability. However, it presents that: Persons with disabilities include those who have long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others. Statistics Most recent data from KNBS(2019 census) shows that at least 2.2% of Kenyans above 5 years old have moderate to severe disabilities. 15% Of the world s population has some form of disability according to WHO estimates 10million Displaced persons are estimated to have a disability according to UNHRC 900,000 Kenyans have moderate to severe disabilities 2007 National Survey for Persons with Disabilities found a higher prevalence rate of 4.6%. The 2009 census, showed that only 2.5% of female persons with disabilities and 5.4% of male persons with disabilities in the labour force, who worked for pay, were employed in the private sector. The 2009 Census and the 2015/16 Kenya Integrated Household Budget Survey found respectively that 3.5%and 2.8 % prevalence for the entire population respectively. These advantages inclusion provides can be looked at from different perspectives Employers Gain a reputation and respect from peers national and internationally for leadership in diversity and inclusion. Further own corporate values and social priorities. Foster an environment that promotes dignity and respect for all persons. Meet and exceed legal requirements. Influence government employment policies. Advancing social justice, promoting decent work

  5. Employment of Persons with Disabilities 2/4 The workplace Gains greater access to talent pool, different skills and abilities. Avoids skills shortage and labour supply issues. Has decreased labour turnover. Increased employee satisfaction and engagement. Improved teamwork, productivity and morale amongst employees. Low incidence of health and safety risks.   6. Employment of Persons with Disabilities 3/4 An inclusive marketplace provides: Access to an overlooked and underserved market segment. Reflection on diverse demands from customers by being receptive and responsive in order to develop better products and services. Fostering of innovation in products and services. Enhanced supplier diversity by sourcing from companies that are owned by or employ persons with disabilities. Enhanced customer loyalty with inclusive marketing and advertising and avoid the negative repercussions of using stereotypes Increased employee satisfaction and engagement. Employment of Persons with Disabilities 4/4 Benefits for the community are: Through increased inclusion and accessibility, contribute to an improved enabling environment for the whole community including businesses to thrive and grow. Contribute to social change through leading by example and positively influencing attitudes. Contribute to the achievement of the Sustainable Development Goals by leaving no one behind.   8. Why are unions critical for disability inclusion 1. Unions are great change advocates-the power of solidarity cannot be understated. 2. They have experience in tackling challenging issues(or perceived challenges). 3. They understand the importance of an inclusive labour market and this can incorporate groups left behind on the basis of gender, disability and refugee status. 4. They understand that certain workers/potential workers are more vulnerable to loss of employment, harassment, exclusion and poverty. 5. The dignity of all persons with disabilities can be upheld through the framework of unions through proper representation and articulation of their issues.   9. What is the Role of Trade Unions in Disability Inclusion 1/2 Trade union actions on disability are directly contributing to the achievement of decent work by; 1. Advocating for increased employment and entrepreneurship opportunities for persons with disabilities 2. Improving workplace conditions 3. Ensuring adequate accommodation of persons with disabilities 4. Ensuring protections against workplace injuries, Advancing social justice, promoting decent work

  10. What is the Role of Trade Unions in Disability Inclusion 2/2 5. Representation of workers concerns, 6. Implementation of laws and standards for the inclusion of persons with disabilities 7. Creating awareness on disability 8. Sensitizing workers on supporting their colleagues with disabilities 9. Promoting non-discrimination Advancing social justice, promoting decent work

  11. Union Role- Advocacy The law(Persons with Disabilities Act 2003) sets a quota of 5% for all employment positions in both public and private sectors be fulfilled by persons with disabilities. Are companies recruiting persons with disabilities? Are employees with disabilities able to articulate issues to corporates or are they in the margins? How can unions advocate for the inclusion of persons with disabilities in formal employment? What happens if a person acquires disability in the workplace and they still have the capacity to work? Union Role- Accommodation Persons with disabilities sometimes require adjustments to their workstations in order to optimize their productivity-these adjustments are known as accommodations or workplace adjustments. What factors make employers reluctant to accommodate persons with disabilities? Is it worthwhile to accommodate persons with disabilities? Advancing social justice, promoting decent work

Union Role-Inclusive Communication Communication ranges from mediums used to advertise employment opportunities, the messaging to encourage persons with disabilities to apply for opportunities, how interviews are conducted, how at enterprise level communication occurs on tasks to be completed and how employees with disabilities are able to articulate their issues to their representatives. In your own community, do you think communication is inclusive? How can unions support inclusive communication at different levels? Advancing social justice, promoting decent work
