Monique Choiniere, the Acting Administrator for Trademark Classification Policy and Practice at USPTO, announces the proposed update of the ID list for the Nice 11th Edition. The update includes changes and additions to the TM5 ID List based on the adoption of Nice 11-2017. The User Guide has been enhanced to include Technical Guidelines for New Term Proposals.

Nice 10-2016 and TM5 ID List Nice 10-2016 In November 2015, USPTO shared spreadsheet with TM5 Partners identifying entries that the USPTO would remove from the TM5 ID List on December 31, 2015, pursuant to adoption of Nice 10-2016. In November 2015, USPTO requested that TM5 Partners refrain from proposing new additions and modification from Nice 10-2016 Alphabetical List to the ID List until after January 1, 2016. USPTO proposed that the common acceptable items of Nice 10-2016 be added to TM5 ID List by means of bulk upload. USPTO compiled a list of Nice 10-2016 additions and modifications acceptable to the USPTO and shared this list with TM5 Partners in January 2016. TM5 Partners confirmed the acceptance or rejection of such terms and corresponding translations by February 12, 2016. Common acceptable items of Nice 10-2016 were added to the TM5 ID List by means of a bulk upload in February 2016. 2/20/2025 3

Nice 11-2017 and TM5 ID List Nice 11-2017 Proposal USPTO proposes to share a spreadsheet by November 15, 2016, identifying entries that USPTO will remove from the TM5 ID List on December 31, 2016, pursuant to adoption of Nice 11-2017. USPTO proposes that the common acceptable items of Nice 11-2017 be added to TM5 ID List by means of bulk upload. USPTO requests that starting July 2016, TM5 Partners refrain from proposing new additions and modification from Nice 11-2017 Alphabetical List and instead vote on the new additions and modifications in bulk. USPTO proposes to compile a list of all 11-2017 additions and modifications acceptable to the USPTO and will share this list with TM5 Partners by January 6, 2017. USPTO will request that TM5 Partners confirm the acceptance or rejection of such terms and submit translations of such terms by February 10, 2017. Common acceptable items of NCL 11-2017 will be uploaded as a bulk upload shortly after February 10, 2017. 2/20/2025 4

  4. Technical Guidelines for New Term Proposals The User Guide on the ID List has been updated to include the Technical Guidelines for New Term Proposals for the TM5 ID List. A separate button and link to the Technical Guidelines for New Term Proposals will be created in a future update to website. 2/20/2025 5

In the period from December 1, 2015* through July 8, 2016, the Partner Offices: Approved 540 proposed entries Rejected 233 proposed entries Removed 157 entries *Day before last annual TM5 meeting.
