All Employees involved in any way with services provided to clients, or who have routine contact with clients, must receive the following training, before having contact with clients and no later than thirty (30) days after beginning employment: (1) Basic health and safety practices; (2) Infection control and infection control procedures; (3) Identification and mitigation of unsafe environmental factors; (4) Emergency and evacuation procedures; (5) Identification and prevention of adult and child maltreatment; (6) Mandated reporter requirements; and (7) Reporting incidents and accidents as required in these standards. (b) Employees required to receive training prescribed in subsection (a) of this section must receive annual retraining on those topics at least once every twelve (12) months. Survey Observations: We have found that some staff do not have annual retraining. humanservices.arkansas.gov

An ADDT must maintain a personnel file for each employee that include: (4) All required Adult and Long-term Care Facility Resident Maltreatment Central Registry checks; Survey Observations: We have found that the provider is not completing the required checks prior to hire. We also see some instances where the facility has not documented it in the Employee file. humanservices.arkansas.gov

Subparts 1 and 2 (1) An ADDT must conduct emergency fire drills and tornado drills at least once a month, each and on separate days, and at different times of day. (2) An ADDT must document all emergency drills completed and include at least: (A) The date of the emergency drill; (B) The type of emergency drill; (C) The time of day the emergency drill was conducted; (D) The number of clients participating in the emergency drill; (E) The length of time taken to complete the emergency drill; and (F) Notes regarding any aspects of the emergency procedure or drill that need improvement based on the performance of the emergency drill. Survey Observations: We have found that facilities are either not conducting/completing the drills or they are not keeping accurate documentation for the drills that are conducted. humanservices.arkansas.gov

(b) An ADDT facility must comply with all: (4) Department of Labor and Licensing requirements including without limitation requirements regarding water heaters and boilers; Survey Observations: Initially we were seeing that providers either did not have a boiler inspection or they had an out-of-date inspection. We are beginning to see providers coming into compliance with this rule. humanservices.arkansas.gov

Have working smoke and carbon monoxide detectors in all areas used by beneficiaries or employees. Survey Observations: Facilities have smoke detectors, but not all have carbon monoxide detectors.   10. Top 5 Tags for EIDTs Early Intervention Day Treatment Top 5 Tags 1. Rule 300.303.2 -- There were 23 instances where this rule was written out of compliance. Employees required to receive training prescribed in subdivision (a) must receive annual re-training on those topics at least once every twelve (12) months. Survey Observations: We found employee files did not contain documentation of the required amount of training hours in a 12-month period We have seen some improvement in this area. humanservices.arkansas.gov

  11. Top 5 Tags for EIDTs Early Intervention Day Treatment Top 5 Tags 2. Rule 300.306.4.01 -- There were 21 instances where this rule was written out of compliance. All new staff including volunteers who are counted in the ratios, shall receive the following orientation (unless the staff has prior documented training in the required areas). Survey Observations: Initially we were seeing that providers were not documenting the new employee orientation. We are seeing improvement in this area. humanservices.arkansas.gov

At no time shall children be left unsupervised or unattended. The child care center shall provide additional staff for any temporary absence of primary child caring staff for activities such as breaks, meal preparation, transportation, etc. Survey Observations: We are seeing this in instances when the facilities have a room that is left out of ratio. We have seen improvement in providers that were struggling in this area. humanservices.arkansas.gov

Rule 302 There were 16 instances where this rule was written out of compliance. b)(1) An EIDT must comply with all requirements applicable to employees under this part and all requirements applicable to employees of childcare centers, including without limitation: (A) Drug screens; (B) Criminal background checks; and (C) Adult and child maltreatment checks. (2) An EIDT must verify an employee still meets all requirements under this part: (A) Upon the request of the Division of Provider Services and Quality Assurance; or (B) Whenever the EIDT receives information after hiring that would create a reasonable belief that the employee no longer meets all requirements Survey Observations: We have seen some instances where one or more of the checks is not completed or the facility has not documented it in the Employee file. humanservices.arkansas.gov

Rule 302(c)(1)- An EIDT must conduct criminal background checks for all Employees as required by law and applicable minimum licensing standards for childcare centers. *You must refer to A.C.A. 20-38-103(a)(1). (a) (1) Before making an offer of employment, a service provider shall inform an applicant that employment is contingent on the satisfactory results of criminal history records checks. (2) If a service provider intends to make an offer of employment to an applicant, the service provider shall conduct criminal history records checks on the applicant under this section. (3) Except as provided in subdivision (a)(4) of this section, if the service provider can verify that the applicant has lived continuously in the state for the past five (5) years, the service provider shall require the applicant to submit a criminal history records check form and shall, in accordance with the rules of the appropriate licensing or certifying agency: (A) Initiate a state criminal history records check on the applicant with the Identification Bureau of the Division of Arkansas State Police; and (B) Conduct a registry records check on the applicant. humanservices.arkansas.gov

(e) (1)(A)When a service provider initiates a request for a state criminal history records check on an applicant for employment with or an employee of the service provider, the Identification Bureau of the Division of Arkansas State Police shall issue within twenty-four (24) hours an electronic report to the licensing or certifying agency. (B)When a licensing or certifying agency submits a request for a national criminal history records check on an applicant for employment with or an employee of the service provider, the Identification Bureau of the Division of Arkansas State Police shall issue a report to the licensing or certifying agency within ten (10) days after receipt of the results of the national criminal history records check from the Federal Bureau of Investigation. (2)After receipt of a report from the Identification Bureau of the Division of Arkansas State Police, the licensing or certifying agency shall determine whether the applicant or employee is disqualified from employment with the service provider based on the criminal history of the applicant or employee and shall forward its determination to the service provider. Survey Observations: We have seen some instances where Employees begin working prior to the provider submitting the checks to ASP or FBI and receiving the approval determination from DPSQA. humanservices.arkansas.gov

  16. Suggestions Suggestions for Providers: Review the regulations and applicable laws. Look closely at the regulations and see if you need to take anything else into consideration. Review recent laws to see if they apply to your provider type. Remember that we look at childcare standards and EIDT standards. Conduct self audits. Reach out to Central Office if you have questions. In your POC, please make sure you address the who, what, when, why, and how. Sign up for updates on the DPSQA website.
