THE PLANNING SCHEME AMENDMENT PROCESS 1.Council decides to make an amendment 2.Council advises the Minister of its decision and provides supporting information 3.The Minister advises Council to prepare a draft amendment 4.Council sends the draft to the Minister for the first State Interest check 5.After the State is happy with the draft, it advises Council to start public consultation

THE PLANNING SCHEME AMENDMENT PROCESS 6.Council carries out the public consultation process Public Notice placed in newspaper 7.Council reviews submissions and: amends draft as necessary advises submitters how it dealt with concerns raised 8.Council sends revised draft to the Minister for the second State Interest check 9.The Minister advises Council that it may adopt the amendment 10.Council decides to adopt the amendment

CONSULTATION (Statutory Guideline extract) There are many benefits to having early consultation with the public and stakeholders when preparing planning schemes, such as: early identification of issues early identification of community values, and greater community ownership of the planning scheme during preparation and once it is adopted.

  6. CONSULTATION (Statutory Guideline extract) Although minimum timeframes are required by SPA for the public consultation stage, local governments have flexibility to choose suitable consultative processes and the length of time consultation occurs during other stages of the process.

STATE PLANNING POLICY (Extract) For coastal hazards erosion prone areas: maintaining erosion prone areas development- free buffer zones within a coastal management district as unless: the development cannot be feasibly located elsewhere, and it is coastal-dependent development, or is temporary, readily relocatable or able to be abandoned development

  12. GROUND LEVEL AND BUILDING HEIGHTS COUNCIL IS PROPOSING TO CHANGE THE DEFINITION OF GROUND LEVEL AND TO INTRODUCE A FLOOD HAZARD ALLOWANCE . THIS WILL ALLOW PERMITTED BUILDING HEIGHT LIMITS TO BE MAINTAINED WHEN FILL IS PLACED ON FLOOD PLAIN.
