Title IX Title IX - - Background Background Civil Rights Act (1964) Title VI: No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance. Title VII prohibits discrimination related to employment Title IX (1972) relates to education.

  3. Title IX Title IX (TIX) (TIX) No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving federal financial assistance. Because Florida College receives federal funds, the College is required to abide by Title IX except to the extent that application of TIX would be inconsistent with the religious tenets of the College.

  4. Responsible Employees Responsible Employees All employees are Responsible Employees, or Officials With Authority (OWA). Must report any actual or suspected TIX violation to the TIX Coordinator, whether or not the alleged victim reports. Must share all information you know: identities of parties, date, time, location, & details about the incident. When on OWA has knowledge, the college has actual knowledge * and is obligated to respond.

  5. Jurisdiction Jurisdiction This Policy applies to conduct that occurs within any education program or activity over which Florida College exercises substantial control over both the respondent and the context in which the sexual harassment occurs, within the United States*. Is it Title IX ? 1. Weight room in the Annex building behind gym? 2. In a car at Riverhills park? 3. In a car on campus? 4. At spring banquet venue? 5. At an upper D student s apartment?

  6. What to Report? What to Report? Sexual Harassment Quid pro quo Hostile environment VAWA (violence against women act) Retaliation Sexual Discrimination Program equity Other forms of discrimination The College has no statute of limitations for sexual harassment. OCR claims must be made within 180 days of an alleged violation.

Sexual Harassment Quid pro quo Hostile environment VAWA Retaliation Hostile Environment Unwelcome conduct Determined by a reasonable person To be so severe* And pervasive And objectively* offensive That it effectively denies a person equal access to the Recipient s education program or activity.

  8. Sexual Harassment Quid pro quo Hostile environment VAWA Retaliation VAWA 1. Dating violence sexual or physical abuse or threat. 2. Domestic violence 3. Sexual assault rape, fondling, incest, or statutory rape. 4. Stalking directed at a specific person cause fear for the person s safety or substantial emotional distress. What if you are unsure if an incident is TIX? Report it.

  9. Consent Consent Intelligent, knowing, and voluntary consent; does not include coerced submission. Does not include failure to offer physical resistance.

  10. Amnesty To encourage reporting of Sexual Misconduct, the College will provide Complainants & bystanders who cooperate with an investigation with immunity from being charged with violations of any other College policy in connection with conduct related to an alleged violation of this policy.

  11. How To Report an Incident Tell the TIX Coordinator: online form, email, phone, note, face to face Tell any non-student employee Tell our confidential source (Holly Cabina) Contact local authorities (e.g. Police)

  12. 3 Paths After A Report Non-TIX Resolution Informal Resolution Formal Resolution TIX Coordinator determines it is not a TIX violation. The case moves to another College process. TIX Coordinator works with parties to facilitate a resolution. A full investigation and formal hearing. In any case the College will provide supportive measures .

  13. Formal Resolution Formal Resolution 1. Investigation led by TIX Coordinator. 2. Live hearing led by Hearing Officer (Dean of Students). Advisors allowed. 3. Appeal, if requested, by Appeals Officer (Provost). An incident between an employee and student requires a formal resolution.

  14. Before TIX Before TIX Love one another with brotherly affection. Outdo one another in showing honor. (Romans 12:10) A prudent man foresees evil and hides himself, But the simple pass on and are punished. (Prov. 22:3)
