What gives Tribes the Authority to Use Tribally Determined Wages (TDW) Program Guidance No. 2003-04, February 5, 2003, from Roger Boyd, Deputy Assistant Secretary for Native American Programs regarding Tribal Laws Pertaining to Use of TDW s Section 104(b) of the Native American Housing Assistance and Self-Determination Act of 1996 (NAHASDA); 24 C.F.R. 1000.16 and 29 C.F.R 1.2 and 1.3.

The TPW/TDW for a Carpenter on the Sault Tribe Housing Authority Wage Chart for 2025 is $25.84 and the current Davis- Bacon Wage Rate for a Carpenter is $52.17.

  7. In Summary 1. Have the Tribal Council/Board Pass a Law or Regulation that approves the use of a TDW. 2. Create an Administrative Mechanism (Procedures) on how TDW s are going to be determined, how often, benefits, a list of positions covered, etc. This is the document that covers how everything gets done. NOT part of the actual Wage Ordinance passes by the Tribal Council/Board, it is a procedure. 3. Execution Putting TDW s into practice and considering what factors would looked at when determining employees wages. The Schedule of Prevailing Wages will be included in the Procurement Packets that go out to vendors once the Tribal Law / Ordinance is passed and the TDW s are established. The following wording will be required to be required in every procurement packet Awarded ordinance. Awarded contractor will also present a copy of their payroll to the XXXXXX Housing Authority upon request, to confirm Tribal Code: Chapter XX is being paid. contractor must comply with the Tribal Code; Chapter XX wage
