  1. Appropriations and Community Project Funding 101 Friday, April 8, 2022 Presented by: Marcus Garza Deputy Chief of Staff and Legislative Director

  2. U.S. Constitution, Article I, Section 9, Clause 7 - No money shall be drawn from the treasury but in consequence of the appropriations made by law; and a regular statement of account of receipts and expenditures of all public money shall be published from time to time." The one function Congress must do each year to keep the federal government functioning. If not, we risk a lapse in funding and government shutdown. Appropriations Process Overview Fiscal Year: October 1-September 30. We are currently in fiscal year 2022, beginning the process to set spending for fiscal year 2023. Authorizing vs. Appropriating The appropriations process can be a back-door way to accomplish policy priorities that are much more difficult to do through the normal authorizing process.

  3. President releases his fiscal year budget in early February. Last year, it was released May 28. This year, it was released March 28. Budget Committees pass a concurrent budget resolution by April 15, setting up the framework Appropriations Committees use to appropriate federal discretionary funding to each department and agency of the U.S. government. Usually, a deeming resolution is passed to provide 302(a) allocations to allow the Appropriations Committee to move forward if a budget resolution is not passed. Expectations vs. Reality a timeline of the process Appropriations request process happens February-March Subcommittee submissions typically 2ndand 3rdweeks of March This year, deadlines are April 27-29.

  4. 12 appropriations subcommittees review member requests, piece together their bills, and begin holding subcommittee markups. The Appropriations Committee holds full committee markups to amend spending bills. The full House of Representatives consider each appropriations bill. This should happen roughly between April-May, now stretches into June-July. This usually happens in May- June, now stretches into July or is never fully completed. This usually happens in June- July, with goal of completing all 12 bills by August Recess. Recent years, Appropriations Committee has used mini- bus packages to get these through the House on an expedited process.

  5. The two chambers conference their respective packages together to pass a negotiated bill that can pass both chambers. The U.S. Senate has its own process, which happens on a far different timeline. President signs appropriations bills into law before September 30th. Visit appropriations.senate.gov for more details. Reach out to Senator Dick Durbin s and Senator Tammy Duckworth s office for more details on Senate Community Project Funding. Usually comes in the form of an omnibus. This process is typically drawn out for several months since both sides can never come to an agreement. Continuing Resolution passed to keep government operating at previous fiscal year levels to avoid a shutdown while negotiations continue. For fiscal year 2022, President Biden signed the Consolidated Appropriations Act, 2022, on March 15, 2022 (5.5 months after start of FY2022)

  6. Identify federal programs or grants that help fund your organization. Identify the type of appropriations request you d like to submit. There are three types: Programmatic Requests specific funding levels for a department or agency program (Ex. $1 billion for TRIO Programs through ED) 1. How to Submit an Appropriations Request Report Language Requests Included in the accompanying report for each House Appropriations Bill and directs action. (Ex. The Committee recognizes the unique needs of the homeless veteran population in states with rural veteran needs. The Committee encourages the VA to conduct pilot programs to address these needs, giving priority to the state with highest number of veterans per capita.) 2. Bill Language Requests Language included directly into the appropriations bill and carries the weight of law. (Ex. Provided further, That 6-day delivery and rural delivery of mail shall continue at not less than the 1983 level ) 3.

  7. Sign onto another Members Request Letter or ask Member to lead a Sign-on Request Letter. Go to Newman.house.gov and visit the Services drop-down tab. Click Appropriations Request and find the link to submit a request (google webform). Provide the basic information we need to review the request. Which agency, funding level needed, draft report/bill language, etc. Only 75 submissions per subcommittee, so we must be selective. Help us understand why this request is important so we can fight for it. Be sure to include your contact information in case we need to follow-up for additional information on your request.

  8. Community Project Funding After nearly 10 years, Congress successfully brought back Congressionally-directed spending last year. New transparency requirements to reduce fraud, waste, and abuse. Financial certification letter that member (and immediate family) will not personally benefit from project. All projects submitted must be shared publicly on Member s website. Only eligible for governmental or non-profit entities. Individuals or for-profit entities are strictly prohibited from receiving funding. Meet all cost-sharing requirements and other criteria that come with that accounts funding. Typically, 80-20 or 75-25 cost-sharing federal to non- federal split. Not all have matching requirements so please carefully review guidance.

  9. Fully utilize all funds within a year of receipt from agency. Some agencies provide longer periods, but one year is standard. Could potentially have funding clawed back if not used within timeframe. Provide letters of support from local mayors/village presidents/state legislators and positive media articles. Demonstrate the community need this funding will help address. Projects in IL-03 or close proximity that serve our constituents will get priority consideration. Visit Newman.house.gov and go to the Services tab to access our CPF Overview webpage and submission form. Please closely review all subcommittee guidance to determine which account is right for you and your organization. If guidance is vague, ask us! We will take your questions to Appropriations staff and get an answer.

  10. PLEASE be sure to include your full organizations legal name, a responsive contact for the organization (direct phone and email address), and as much information you can to build a case for your project. If we have questions, we will follow-up directly to ensure we get everything we need to submit your project for consideration. Please be responsive and ready to provide additional information at a moment s notice. If we miss a submission due to unresponsiveness, funding could be jeopardized! Other helpful items to include to strengthen your projects chances: Budget proposals detailing how funding will be spent on allowable uses.

  12. All Appropriations and Community Project Funding requests are due to our office by Wednesday, April 13, 2022, by 11:59 pm. All Members of Congress must submit their requests to the Appropriations Committee between April 27- 29, 2022. DEADLINE FOR SUBMISSIONS We apologize for the tight turnaround, but these dates are necessary for us to review dozens of projects and hundreds of programmatic/language requests. If you desperately need another day or two, please contact us immediately so we can assess your situation. Will be case-by-case. Notifying us early is always best.
