  16. Bid Evaluation Process Gate 3 Price Points for the price evaluation will be calculated in accordance with the formula stated below. Bidders are required to complete all line items in the pricing response template provided by SARS, which will be used for the price evaluation. The price should be all-inclusive for all the goods and services required in the scope of work, and bidders must ensure the completeness and accuracy of the pricing figures provided in the pricing response template. Failure to complete the pricing response template may lead to a bidder scoring zero for the pricing evaluation or disqualification of the bidder. POINTS AWARDED FOR SPECIFIC GOALS Gate 3 BBBEE Number of points allocated The specific goals allocated points in terms of this tender (80/20 system) Evidence Required Remarks (To be completed by the organ of state) SARS Internal Preferential Policy provides for: B-BBEE certificate or Sworn Affidavit The promotion of Small Medium and Micro Enterprises (SMME), Exempt Micro Enterprises (EME) and Qualifying Small Enterprise (QSE) The entity is an EME/QSE 14 B-BBEE certificate Large Enterprise 4 Bidders are required to submit CIPC registration documents or letter from an attorney or registered accountant in their letterhead for the verification of ownership points claim. 1. An increase in participation of women owned entities (particularly black women entities) providing goods and services to SARS through a competitive procurement process. Enterprise with Women Ownership of 30% and more 6 1. Additional 6 points added to the above entities if they have women ownership of 30% and more. 16

  18. POINTS AWARDED FOR SPECIFIC GOALS Gate 3 BBBEE The maximum points that may be allocated for Specific Goals is 20 Specific Goals Evaluation (Gate 3, Stage 2) 1. Points for the specific goals evaluation will be allocated in accordance with a bidder s size as per table 1 of the SBD 6.1. Points for specific goals can only be awarded to a bidder who submits a valid B-BBEE certificate or affidavit together with the SBD 6.1 Preference points claim form. 2. Bidders are required to submit Share Certificate of the company or CIPC registration documents or letter from an attorney or registered accountant in their letterhead for the verification of women ownership and localisation points claimed. 3. Bidders who do not claim preference points may be scored zero for specific goals. 4. Failure of a bidder to submit a B-BBEE certificate from a verification agency accredited by the South African Accreditation System (SANAS), a CIPC B-BBEE Certificate for Exempted Micro Enterprise (EME), or a sworn affidavit confirming annual turnover and level of black ownership in the case of an Exempted Micro Enterprise (EME) and Qualifying Small Enterprise (QSE) and Share Certificate of the company or CIPC registration documents or letter from an attorney or accountant in their letterhead for the verification of ownership points claim together with the proposal, will be interpreted to mean that preference points for Specific goals are not claimed. 5. The B-BBEE certificate or affidavit should be submitted in the name of the bidding entity. If the proposal is submitted by an incorporated joint venture, the incorporated joint venture must submit their B-BBEE status level verification certificate or affidavit. 6. If the proposal is submitted by an unincorporated joint venture arrangement, the unincorporated joint venture must submit a consolidated B-BBEE certificate or affidavit as if they were a group structure, and that such consolidated B- BBEE certificate or affidavit is prepared for every separate proposal. 7. SARS reserves the right to request bidders to submit proof of any information, to substantiate claims made about their Specific goals. 17

  19. POINTS AWARDED FOR SPECIFIC GOALS Gate 3 BBBEE 3.6 The B-BBEE certificate or sworn affidavit should be submitted in the name of the bidding entity. If the proposal is submitted by an incorporated joint venture, the incorporated joint venture must submit their B- BBEE status level verification certificate or sworn affidavit. If the proposal is submitted by an unincorporated joint venture/consortium arrangement, the unincorporated joint venture/consortium must submit a consolidated B-BBEE certificate or sworn affidavit as if they were a group structure, and that such consolidated B-BBEE certificate or sworn affidavit is prepared for every separate proposal. 18

Specific goals points allocation Specific goals evaluation Points Bidders to submit: a) A duly completed SBD 6.1 Preference point claim form, and b) A valid B-BBEE certificate or sworn affidavit. 20 The following table indicates the specific B-BBEE documents that must be submitted for this RFP to claim Specific goals points. 19

  21. JOINT VENTURES AND SUB -CONTRACTING Joint Ventures and Consortiums A trust, consortium or joint venture (including unincorporated consortia and joint ventures), will qualify for points for their B-BBEE status level as a legal entity, provided that the entity submits their consolidated B-BBEE status level Verification Certificate scorecard and that such a consolidated BBBEE scorecard is prepared for every separate bid. Proof of Existence: Joint Ventures Bidders must submit proof of the existence of joint ventures arrangements. SARS will accept signed agreements as acceptable proof of the existence of a joint venture arrangement. The above-mentioned joint venture agreement must clearly set out the roles and responsibilities of the Lead Partner and the joint venture party. The agreement must also clearly identify the Lead Partner, who shall be given the power of attorney to bind the other party/parties in respect of matters pertaining to the joint venture arrangement. 20

  22. Bid Evaluation Process: Gate 3 B-BBEE 1.5 Failure on the part of a tenderer to submit proof or documentation required in terms of this tender to claim points for specific goals with the tender, will be interpreted to mean that preference points for specific goals are not claimed. 1.6 The organ of state reserves the right to require of a tenderer, either before a tender is adjudicated or at any time subsequently, to substantiate any claim in regard to preferences, in any manner required by the organ of state. SARS reserves the right to request that bidders submit their Black ownership and turnover information in support of their Affidavits. 21

Financial Analysis Evaluation Bidders are required to submit the public interest score and complete sets of audited / independently reviewed annual financial statements in compliance with the Companies Act for the three (3) most recent financial periods in the name of the bidding entity. The financial statement analysis will be conducted on the shortlisted bidder. The annual financial statements must contain: Statement of Profit and Loss and Other Comprehensive Income; Statement of Financial Position; Statement of Cash Flows; Statement of changes in equity/ net assets ; and Accompanying Notes. Entities which are trading for less than three (3) financial periods must provide: A letter detailing that fact, signed by a duly authorised representative of the entity; The annual financial statements that the entity is able to provide, taking into account the period that it has been trading; and Any other information or documentation which would provide more clarity on the financial history of the bidder. 23

  25. Financial Analysis Evaluation In the event of the bid being in the form of a Joint Venture (JV), the following is required: Annual financial statements of the JV for a registered JV and for unincorporated JV annual financial statements of each company; A JV legal agreement detailing the percentage ownership of each entity; and A consolidated B-BBEE Certificate. SARS reserves the right to request further information with regards to the annual financial statements of a bidder at a later stage. 24

Master Service Level Agreement Bidders are requested to: Comment on the terms and conditions set out in the Service Level Agreement and where necessary, make proposals to the terms and conditions; Each comment and/or amendment must be explained; and All changes and/or amendments to the Service Level Agreement must be in an easily identifiable colour font and tracked for ease of reference. SARS reserves the right to accept or reject any or all amendments or additions proposed by the successful bidder if such amendments or additions are unacceptable to SARS or pose a risk to the organisation. 26
