Overview of Legislation This new law affects purchases FSU makes from foreign countries of concern (i.e., money, property, or services flowing out of the university) https://www.flsenate.gov/Laws/Statutes/2023/0288.860 BOG Regulation 9.012: https://www.flbog.edu/regulations/active- regulations/
Whats New? In May 2023, the Florida legislature amended section 288.860, Florida Statutes, which outlines requirements for participating in partnerships, agreements, or receiving grants from foreign countries of concern. The amended statute specifies that any state university authorized to expend state-appropriated funds may not accept any grant from or participate in any partnership with any foreign principal based in a foreign country of concern without the approval of the Board of Governors. The Board may approve partnerships or agreements deemed valuable to students and the state university and are not detrimental to the safety or security of the United States or its residents.
Whats New? (continued) In accordance with the Board of Governor s ensuing Regulation 9.012, Foreign Countries of Concern include: The People s Republic of China (Hong Kong, Macau) The Russian Federation The Islamic Republic of Iran The Democratic People s Republic of Korea (North Korea) The Republic of Cuba The Venezuelan regime of Nicholas Maduro The Syrian Arab Republic
Whats New? (continued) BOG Approval may be needed for certain purchases that enter into agreements with certain foreign countries of concern. All SUS institutions are required to submit an annual report to the Board of Governors beginning October 1, 2024 detailing agreements and partnerships with foreign countries of concern. This new process applies to any agreements starting or renewed after July 1, 2023, and any partnerships or grants starting or renewed after December 1, 2023.
Whats New? (continued) A procurement of goods or services from higher education institutions or other individuals or entities in foreign countries of concern are not subject to this new requirement unless the agreement contains a mutual expression of interest in academic or research collaboration. Certain agreements may, however, still be subject to reporting requirements of the BOG, even if they do not require advance BOG review. Examples of purchases that require extra review: electronic purchases, database subscriptions, hazardous materials, consulting services agreements, conference sponsorships, unique terms of licensing agreements, data sharing obligations, and other purchases or agreements that may be construed as an academic or research collaboration. to be a frequent issue.t of the agreement related to research collaboration, as defined by
Process Changes Procurement Services augmented existing processes and documents to ensure FSU is compliant with the recent law changes: FSU s supplier onboarding system, PaymentWorks, asks registering suppliers to confirm they are not a foreign principal of a country of concern as part of the onboarding process. Updated language in the FSU purchase order standard terms and conditions, as well as the university s standard contract templates. SpearMart s sourcing module, asks respondents to competitive solicitations to confirm they are not a foreign principal of a country of concern. PCard purchases will require prior approval and a waiver in advance of any purchase from these countries.
Process Changes (continued) Departments are encouraged to be cautious when sharing university data, intellectual property, purchasing commodities or services for academic or research purposes, and/or purchasing commodities and services where the point of origin is unknown (i.e., Amazon Marketplace).
