Reentry and Reintegration Workgroup Key Takeaways Reentry and reintegration crisis predated Covid-19; the pandemic simply created new urgency behind the implementation of proven strategies. Because the criminal justice system disproportionately affects marginalized groups, the response to COVID-19 has major impact on people of color and LGBTQ communities. Expedited releases Dramatic reduction of incarcerated populations across the state, and a changing role of courts leaves traditional post-release planning unable to adequately respond. Reduced but largely stabilized jail populations Council members Mack Jenkins and Judge Stephen Manley suggest using available research and re-thinking services offered pre-plea to create positive monitoring and prevent new offenses moving forward.
Reentry and Reintegration Workgroup Proposed Reentry Policy Brief Provide updated information about releases and available resources to support people coming home from prison and jail o Health Survey Responses indicate overwhelming need for mental health services both pre-trial and post-trial Medi-Cal system doesn t support assessments and referrals when people are still in custody, which makes it hard to do discharge planning

Prevention and Diversion Workgroup Update Workgroup Meeting Highlights Statewide jails have reduced population by 26-30%; examples: Santa Clara County has reduced almost 40% due to Covid-19. Innovative solutions taking place with existing resources Engage in discussion with partners out in the community to make sure we can keep jail population low again; How do we work with people out in the community with pending court dates and work to keep them from reentering the jail system? The importance of engaging additional stakeholders and key partners in the discussion for creative and innovative solutions for diversion, utilizing existing resources.

Legislative Update Twelve (12) ballot measures that will be on the November 3, 2020 ballot for election Proposition 14: (Bonds) Issues $5.5 billion in bonds for state stem cell research institute Proposition 15: (Taxes) Requires commercial and industrial properties to be taxed based on market value and dedicates revenue Proposition 16: (Affirmative Action) Repeals Proposition 209 (1996), which says that the state cannot discriminate or grant preferential treatment based on race, sex, color, ethnicity, or national origin in public employment, education, or contracting
Legislative Update Proposition 17: (Suffrage) Restores the right to vote to people convicted of felonies who are on parole Proposition 18: (Suffrage) Allows 17-year-olds who will be 18 at the time of the next general election to vote in primaries and special elections Proposition 19: (Taxes) Changes tax assessment transfers and inheritance rules Proposition 20: (Law Enforcement) Makes changes to policies related to criminal sentencing charges, prison release, and DNA collection
Legislative Update Proposition 21: (Housing) Expands local governments' power to use rent control Proposition 22: (Business) Considers app-based drivers to be independent contractors and enacts several labor policies related to app- based companies Proposition 23: (Healthcare) Requires physician on-site at dialysis clinics and consent from the state for a clinic to close
Legislative Update Proposition 24: (Business) Expands the provisions of the California Consumer Privacy Act (CCPA) and creates the California Privacy Protection Agency to implement and enforce the CCPA Proposition 25: (Trials) Replaces cash bail with risk assessments for suspects awaiting trial

IV, Sec. 10(c)), (J.R. 61(b)(18)) Final recess begins upon adjournment (J.R. 51(b)(3)). Sept. 30 Last day for Governor to sign or veto bills passed by the Legislature before Sept. 1 and in the Governor s possession on or after Sept. 1 (Art. IV, Sec. 10(b)(2)). Legislative Update Current Legislation CCJBH is Monitoring AB 1950- (Kamlager D) Probation: length of terms. (Enrollment 8/24/2020). Current law authorizes courts that have jurisdiction in misdemeanor cases to suspend the sentence and make and enforce terms of probation in those cases, for a period not to exceed 3 years, except when the period of the maximum sentence imposed by law exceeds 3 years, in which case the terms of probation may be imposed for a longer period than 3 years, but not to exceed the time for which the person may be imprisoned. This bill would instead restrict the period of probation for a misdemeanor to no longer than one year, except as specified. SB 854- (Beall) Health care coverage: Substance use disorders (DEAD 5/29/20). This bill will remove the clause of prior authorization requirements before authorizing prescription drug benefits for the treatment of substance use disorders. SB 855- (Wiener) Health coverage: mental health or substance abuse disorders (Second Reading 8/25/20). This bill strengthens the California Parity Act to require insurers cover medically necessary treatment for all mental health and substance use disorders, not just in emergency care.
Legislative Update Current Legislation CCJBH is Monitoring (continued) SB- (Umberg) Mental Health Services Fund: county jails. (Appr. Suspense File 8/18/2020). This bill would establish the Jail-Based Community Mental Health Innovation Program (JBCMHIP). The program would authorize up to 8 counties, including Orange County, with approval from the Mental Health Services Oversight and Accountability Commission, to use MHSA funds to establish county JBCMHIPs to introduce innovative approaches to meet the mental health needs of persons in jail, including persons who have been convicted of a felony and sentenced to imprisonment in a county jail. The bill would specify the duties of an approved county and would require an approved county to include the program in the county s 3-year MHSA plan or periodic updates. AB 2028- (Aguiar-Curry) State agencies: meetings (Third Reading 8/25/2020) The Bagley Keen Act requires the state body to provide notice of its meeting, including specified information and a specific agenda of the meeting, as provided, to any person who requests that notice in writing and to make that notice available on the internet at least 10 days in advance of the meeting. This bill will require these writings and materials to be made available on the internet at least 10 days in advance of the meeting and that a state body may only distribute or discuss these writings or materials at a meeting of the state body if it has complied with these requirements.
