Overview on Foreign Service Directives Cyclical Review Process July 11, 2018
Hope to answer: What is the Foreign Service Directives Cyclical Review process? What is happening in the FSD cyclical review right now? How can PAFSO members best prepare for the next round? (Cannot disclose substantive discussions at bargaining table due to confidentiality mandate)
FSDs in a nutshell Provide allowances, benefits and conditions of employment for employees and dependents posted abroad. Based on three principles: comparability with life in Canada, incentive-inducement to serve abroad, and program-related needs. Comprise 41 individual directives that are taken together as a single entity In 2014-2015, approx $135 million spent on 41 FSDs to 1,767 Canada-based staff, accompanied by 2,991 dependants, posted in 174 missions, located in 107 countries. FSDs deemed to be part of collective agreements FSDs do not expire like collective agreements
FSD Cyclical Review - whos involved? FSDs and cyclical review negotiated via: National Joint Council Treasury Board (employer) Bargaining Agents: PAFSO (FS) PSAC (PM, AS, FB) PIPSC (CO, DS)
Cyclical Review Process Step 2 - input call triggered based on what is prescribed in directive itself. The FSDs call for a review every 3 years. Step 3 - FSDs are examined by the bargaining agents and employer. Respective orgs submit proposals for changes, etc. to the NJC. Step 4 General Secretary of NJC reviews proposals and determines if all fall within scope of committee and can be part of deliberations of cyclical review Step 5 Committee members given opportunity to opt out of negotiations. None have ever opted out. Step 6 Committee reviews proposals one by one (lengthiest part of process) Step 7 package of proposals approved by sub- committees and FSD Committee submitted to NJC - becomes new version of directive
Recent History of FSD Cyclical Reviews 1993 cyclical review Two-phase process of review in 2001-2002. The FSDs were consolidated and updated in steps during these years, with the final version taking effect in June 2003 Cyclical review in 2009 Administrative Clean Up in 2013
Current FSD Review Cycle Input call issued 2012 - last formal cyclical review was 2009, so 2012 was fairly in line with what is called for in the FSDs to have a review every three years. Significant delay in between steps 2 and 3. A number of things happened during this time: PAFSO was in the midst of collective bargaining and then went on strike - was not resolved until late summer/fall 2013 DRAP also going on during this time Following the strike, the employer side requested that PAFSO delay the review process PAFSO also less interested in a review during this time due to political climate and what seemed limited chances for improvements A clean up of the FSDs in 2013, but not a full review. Was an administrative process resulting in 246 deletions and 274 instances of incorporating or moving parts of the FSDs. There were no additions made, nor were there any modifications of the substantive aspects of the FSDS. 2015 Federal Election Note date next to step 4. Deadline to add any new issues/proposals for negotiation was March 2017. We cannot add any new formal proposals in this cyclical review.
