Americans with Disabilities Act To make American society fully accessible to people with disabilities To ensure that people with disabilities have the same rights and opportunities as everybody else
Americans with Disabilities Act Title I - Employment Title II - Public Services Title III - Public Accommodations Title IV - Telecommunications Title V - Miscellaneous
What does the ADA Cover? Physical or mental impairment that substantially impacts 1+ major life activities (breathing, walking, reading, seeing, thinking, working, hearing) Can be moderated or mitigated May be temporary Includes people with a record of impairment or that may be regarded as having an impairment
Public Services: State and Local Government Prohibits discrimination based on disability by state and local government Requires provision of reasonable accommodations to make programs, services and activities accessible Cannot deny or force participation in separate programs All states must follow regardless of size
Meeting the Requirements and Spirit of the ADA Effective communication Reasonable modifications Ensuring access (i.e. access to programs/services in existing facilities; construction and alterations) Ticket sales and testing accommodations Administrative requirements Building a culture of full participation and belonging
Reasonable Modifications Must make reasonable modifications to allow people with disabilities to participate. Required to consider the choice of aid requested Encouraged to consult with person to assure need is met
Reasonable Modifications, continued May turn down modifications if: Result in a fundamental alteration of basic nature of the program or service Modifications threaten others safety Result in undue financial or administrative burden Cannot charge extra for services to cover cost If turning it down, must find a suitable alternative
Examples of Reasonable Modifications Allowing someone with diabetes to have food in an area that does not allow food Allow service animal if there is a no pets policy Providing materials in advance of a meeting Providing a live captioner for virtual meetings Assistance in completing an application for benefits Provide large print documents
Service Animals Dog that has been trained to perform tasks related to a person s disability Do not have to be registered, certified, or licensed Entities may not ask about extent or nature of someone s disability Comfort, therapy, and emotional support animals do not qualify
Public Communication Communication should be as effective disabilities be as effective as communication with people without disabilities Entities must provide auxiliary aids and services when needed to communicate effectively Consider nature, length, complexity, context and usual method(s) of communication. Applies to person with a disability using services, or a spouse, parent, companion as needed
Regulation and Enforcement of the ADA Entities with 50+ employees must have grievance procedure and coordinate agency s efforts to comply with ADA Serves as point of contact for people with disabilities seeking accommodations and investigates complaints Regulated and enforced by the U.S. Department of Justice http://www.ada.gov
