  6. JIC CODE OF STUDENT CONDUCT Purpose Sets the grounds for disciplinary action procedures and the rights of students Actions Summary Revisions have been made to the existing policy language to include content, formatting, and terminology edits, consistent with statutory language 6

  7. Safe Harbor Provision 2014-2015 Language Proposed 2015-2016 Language A student may approach a school official and voluntarily surrender an object, the possession of which is prohibited by the Code of Student Conduct. Unless an investigation by school officials regarding the possession of this particular object has already commenced, if a student approaches a school official and voluntarily surrenders such an object, then the student will not be subject to disciplinary action. The student's parent/guardian will make arrangements to pick up the object from the school, if applicable A student may approach a school official or contracted personnel and voluntarily surrender an object, the possession of which is prohibited by the Code of Student Conduct. Unless an investigation by school officials regarding the possession of this particular object has already commenced, if a student approaches a school official or contracted personnel and voluntarily surrenders such an object, then the student will not be subject to disciplinary action. An investigation is initiated when a school official or contracted personnel becomes aware of a prohibited item. The student's parent/guardian will make arrangements to pick up the object from the school, if applicable 7

Level 1 Offenses 2014-2015 Proposed 2015-2016 Language 1K- Repeated Misconduct: Repeated behavior that includes one or more Level 1 Offenses 1K- Cellular Telephone/Technology Violation: The misuse of wireless communication devices, including but not limited to, cellular telephones, MP3 players, iPods, e-readers, and other electronic devices 1L- Tardiness: Repeated late arrival to school or class 1L- Tardiness: Repeated late arrival to class 1M- Unauthorized Absence from School or Class: Violation of the state attendance laws 1M- Unauthorized Absence from School or Class: Violation of the state attendance laws. This includes leaving school grounds without authorization 8

Level 3 Offenses 2014-2015 Proposed 2015-2016 Language 3L- Smoking and Other Use of Tobacco Products: The possession, use, distribution, or sale of tobacco products, or items represented to be of said nature 3L- Smoking and Other Use of Tobacco Products: The possession, use, distribution, or sale of tobacco products, or items represented to be of said nature. This includes, but is not limited to, electronic cigarettes, vapors, and hookah pens 12

Level 3 Offenses 2014-2015 Proposed 2015-2016 3Q- Other Serious Misconduct: Any other major act of misconduct which seriously disrupts the orderly operation of the school program, or any school activity, or transportation services which threatens the health, safety or property of self or of others or behavior not specifically described above which substantially disrupts the orderly conduct of a school, school function, or an extracurricular/co- curricular activity. This may include, but is not limited to, providing false/misleading information to staff members, profanity, or language intended or reasonably calculated to insult and/or incite another person; repeated dress code violations; misuse of electronic items or computers; substantially disrupting a bus driver which causes or has the potential to cause a safety hazard on a moving bus; or the activation of a fire alarm without reasonable cause which, in the discretion of the principal, was not the result of a willful or malicious act 3Q- Other Serious Misconduct: Any other major act of misconduct which seriously disrupts the orderly operation of the school program, or any school activity which threatens the health, safety or property of self or of others or behavior not specifically described above which substantially disrupts the orderly conduct of a school, school function, or an extracurricular/co-curricular activity. This may include, but is not limited to, providing false/misleading information to staff members, language intended or reasonably calculated to insult and/or incite another person; or the activation of a fire alarm that was not the result of a willful or malicious act 13

Level 3 Offenses 2014-2015 Proposed 2015-2016 Language 3R- Possession of Other Instruments or Objects: Possession of any instrument or object that could be used as a weapon other than a firearm may be considered under this heading if there has been no threatening or intimidating display of the instrument or object. 3R- Physical Aggression on an Employee or Contracted Personnel: The willful use of force upon an employee or contracted personnel that does not result in bodily injury 3X- Misconduct on School Bus or School Approved Transportation: Repeated or serious misconduct which interferes with the orderly, safe, and expeditious transportation of students or other authorized riders 14

Level 4 Offenses 2014-2015 Proposed 2015-2016 Language 4D- Battery of Employees, Contracted Personnel, Volunteers, or Students: An actual or intentional touching or striking of an OCPS employee, contracted personnel, volunteer, any other adult, or OCPS student against his/her will or intentionally causing bodily harm to an individual. The attack must be serious enough to warrant consulting law enforcement and result in more serious bodily harm. In severe cases, the battery of a student may be the basis for expulsion. 4D- Battery of Employees, Contracted Personnel, Volunteers, or Students: An actual or intentional touching or striking of an OCPS employee, contracted personnel, volunteer, any other adult, or OCPS student against his/her will or intentionally causing more serious bodily harm to an individual. The attack must be serious enough to warrant consulting law enforcement. In severe cases, the battery of a student may be the basis for expulsion. 16

Level 4 Offenses 2014-2015 Proposed 2015-2016 Language 4K- Other Weapon: The possession, use, or control of any instrument or object, other than a firearm, which could be used to inflict harm on another person or to intimidate any person. Included in this category are objects such as BB guns or pellet guns, air soft guns, paintball guns and replicas of any gun or weapon, knives of any kind (including common pocket knives), chains, pipes, common household tools, razor blades, box cutter/utility knife, ice picks, other pointed instruments, nunchucks, brass knuckles, explosives, Chinese stars, Billy clubs, tear gas guns, pepper spray or electrical/chemical weapons or devices. ADD- Section 7(c) Current Language Proposed 2015-2016 Language The investigation of a reported act of bullying or harassment is deemed to be a school-related activity and begins with a report of such an act. Incidents that require a reasonable investigation when reported to appropriate school authorities shall include alleged incidents of bullying or harassment allegedly committed against a child while the child is en route to school aboard a school bus or at a school bus stop 21
